No customer contact or employee dispatch are proposed and standard offrce equipment will be used at the residence. Decision: Approval, in accordance with the attached conditions and findings. Other Uses That Mey Be ^ uthorized Ry The Decision: None. This decision authorizes a home occupation in accordance with the Springfield Development Code. All other uses of the property are subject to applicable state law, local ordinances and permit procedures. Site rnformation: The proposed site is located at 609 Summit Boulevar4 also described as Tax Lot 7000 on Assessor's Map 17-03-34-14. The property is zoned and designated Low Density Residential. The subject property is a corner lot at the intenection of Summit and River View Boulevards. Sunset Drive and Presscott Lane also intersect adjacent the subject sirc. All affected streets are local streets having substantial slope. The subject site has a standard residential curbcut and driveway providing oFstreet parking for two vehicles. The residential structure has an attached garage converted to offrce use. Written Comments: Home Occupation Permit Applications require the notification of property owner/occupants within 300 feet of the property allowing for a 14 day comment period prior to a staff decision. Three letters were received that cited naffic safety issues which are addressed summarily: (1) "On-steet parking in the vicinity of 609 Summit is limited to the west side of Sunset from the front of my home northward, the west side of Summit near its junction with Sunse! and in front of 606 Summit across the street from Mr. Vanderkley. I have observed business vehicles parked in all three of these areas. Vehicles have been parked so close to my driveway that visibility is restricted when trying to exit.... If .y understanding is clear, then approval of the application would obligate Mr. Vanderkley and his associates to abide by the appropriate covenants. Failure to comply to these conditions would cause undue congestion that'may be difficult to deal with. It is with these concerns only that we submit our approval for the issuance of a permit..." My husband and I have several concerns regarding the Vanderkley Home Occupation Permit. Lot 7000 has a very narrow sheet and folks going uphill on View Boulevard have no vision clearance around a very blind corner. When a vehicle is parked across from the subject property, adjacent lot 10,300, and a car is taveling down Summit, negotiating the turn on to View, a car traveling uphill will hit the down traveling car head on, as there is no vision nor space for three vehicles on the road. This almost happened to me last week, when I was coming home from work around 5:30 p.m. A vehicle owned by Vanderkley was parked there, a vehicle coming down the hill had to get in the left hand lane to get around the pick up, I was Eaveling uphill hugging the right hand curb, and we almost hit head-on... ...a vehicle parked on either side (Lot 7000 or Lot 10,300) causes extreme and unnecessary hazards, especially when that vehicle is a van or a pick-up. So our concems are with traffic, No. 6 & I I under your Criteria... Should those two areas be resolved....we have no objections." De & Jerry Little 700 Summit Boulevard Springfield, OR97477 STAFF RESPONSE: The proposed home occupation is operated by members of the family residing at the subject site. The family has two standard vehicles, one of which is a commercially marked pick-up truck. Family vehicles must use off-street parking provided at the residence. The driveway access must provide l0' vision clearance areas on either side in accordance with SDC 32.070. No additional vehicles are allowed for the operation of the business. Normal residential traffic to the residence must use legal on- street parking and is subject to City Code parking regulations. Review Standards: The application shall be approved, approved with conditions or denied based on compliance with the standards and conditions of Section 16.100(6) of the Springfield Development Code. Staffshall develop findings demonstrating that the special siting standards have been met: Section 16.f00(6) -A home occupation is a lawful activity cerried on within a dwelling by a member or members of the family who occupy the dwelling. A home occupation may be approved provided that: _ (a) The primarT use of the building is a dwelling; J A residential structure occupied by the applicant is the primary use of the site. No changes to the structure are proposed. (b)The occupation is a secondary use that does not significantly affect the residential character of the dwelling or neighborhood; and The proposed occupation will be conducted from an office space inside the residence, by a member of the family occupying the dwelling. Operation will not affect the residential character of the dwelling or neighborhood because no changes to the outward appearance of the residence are proposed, the number of vehicles allowed for the business is limited and off-street parking is provided at the site. (c) Compliance with the following appticable conditions shall occur at all times: l. Reserved for Future Use. 2. There shall be no display which would indicate from the exterior that the building is being used for any purpose other a residential dwelling; No display inconsistent with residential use isproposed. The applicant shall sign an agroement with the City acknowledging the conditions of subsection 16.100(6)(c) as well as additional conditions deemed necessary to achieve compliance.
