I can understand your concern for the safety of your children and that, fo1- lowing a pol'iceman's advise, you erected a temporary fence to keep the neigh- borhood children from harassinq your children. Since I have not heard from you since our telephone conversation of July 31, 1980 I am sending you this letter. The Springfield City Codes have no prov'isions for temporary fences. If you wish to keep the fence you will need to obtain a fence permit throuqh the Springfield Building Div'ision. The fence will also need to be brouqht up to applicable codes. Please find attached a copy of the Springfield C'ity Code relative to fences. The following are hereby declared to be nuisances to be abated or prosecuted as an offense as provided in this code: (c) Fences (1) A fence in a structurally unsound condition. (2) Fences which present an unfinished or unsightLy appearance from public property or from adjacent private propeity. (a) Fences having a finished and unfinished side shal-l be so constructed as to present an equall-y finished appearance from either side and in the event Lhey do not comply with this provision shaI1 be considered prima facie unfinished or unsightly and a nuisance under the provis- ions of this subsection. SpringfieLd Comprehensive Zoning Code In any residential zone, a wa11-, fence, or hedge 3\ feet in height above the sidewalk grade may be located and maintained on any part of a lot. On an interior 1ot, a waI1, fence, or hedge not more than six feet in height may be located any- where on the l-ot. to the rear of the required 15 foot front yard setback line. On corner lots a six foot fence may be located anywhere on the Lot except in the required 10 foot side and L5 foot front yard setback line.
