The ninimum area for the partitioning of land must be 10 acres. The subject property is just over one acre. In this case, the folloning shall be net: a.The efficient and full urban use of the property, or neighboring properties shall not be limited by the partition. The request has met the criteria of approval above. b.Proposed Iand uses and densities must conform vith the Hetro Plan and the Springfield Development Code. 0nly those land uses permitted in the UF-10 0verlay District vitl bepermitted. Detached single fanily dwellings shall be sited so as to allov for the future division and/or more intensive use of the property. This standard does not apply unless the existing house on Parcel 3 is removed or demolished. In any case, future dvellings viII be sited according to the required setback and solar standards applicable at the time of construction. CONDITIONS OF APPROVAL Section 34.070 of the Springfield Development Code states: AII proposed partitions shall meet the public and private i.mprovement standards of Article 32, PUBLIC AND PRIVATE IMPROVEMENTS. 1 Additional Right of Vay and Street Improvements. Ilhenever an existing street of inadequate vidth is abutting or vithin a site requiring Development Approval, additional right of vay shall be required. Dedication of right of way for South 43rd Street: 30 feet to centerline. This dedication of right of lray needs to be on a Lane County form. Have your surveyor obtain a form for you to sign. 2. The property ovner shall sign an annexation agreement vith the City. An Annexation Agreement form is attached. This form must be signed by aII property olrners and notarized. -3- 3. The Lane County Sanitarian shall certify that each parcel can support a septic systen or that the existing septic systen is adequate. A letter signed by the Lane County Sanitarian certifying the above r,rill be requi red. PINAL HAP AND DEVELOPHEI{T APPROVAL Vithin LZ months of the date of Preliminary PIan Approval, a Final Map sha]l beprepared by a surveyor on quality paper 8 L/ztt x 14rr in size shoving the parcelssurveyed and pins set. Tvo copies of this Final Map incorporating any conditions ofthe Preliminary PIan Approval (in this case, the three conditions listed above) sha1l be submitted to the Planning and Development Department along with legal descriptionsof the nev parcels and any other required legal documents. Final Map submittal shal1be considered a Type I procedure. If the applicant has not completed the abovevithin the 12 month period, Preliminary Plan Approval shall become null and void andresubmittal of the request shall be required. Note: The Pinal Hap and the documents required above must be received byPlanning and Development Department staff no later than December 11, 1988. The Director must eertify that all conditions Iisted under Preliminary plan Approvalhave been met prior to Final Map Approval and Development Approval, i.e., bliore abuilding permit may be issued or property transferred. -4- ATTAGHMENT B CITY OF SPRINGFIELD PLANNING AND DEVELOPMENT DEPARTMENT DECISI0N 0N REQUEST DATE December 4, 1987 APPL ICANT Sherman Ruttencutter 940 South 43rd Street Spri ngfiel d, 0regon 97478 SUBJECT Request to install a manufactured home at 940 South 43rd Street as the reason for the partition request. Journal l'lumber 87-11-155. BACKGROUND INFORMATION The City of Springfield began enforcing land use and building requests in the Urban Growth Boundary of the City of Springfie'ld in 1986. The City of Springfield's Development Code requirements/standards govern development in the Urban Growth Boundary. The Springfield Development Code allows manufactured homes to be p'laced within mobile home parks or manufactured home subdivisions. The on'ly exception to allowing mobile homes on individual Low Density Residentially zoned property is if a mobile home/manufactured home were legal'ly installed and is being replaced with a Class A or Class B unit within 90 days of the day the original unit's removal . The files we received from Lane County do not indicate any permits were issued for the installation of a mobile home on this property. The County Assessment records do not reflect a mobile home being on this lot. There is only one address 'listed for this property on the County Assessment records. A site visit revealed a pole with an electrical meter in the approximate location of where this home would be placed according to the p]ot plan, however, there was no mobile home on the property. A conversation with the Springfield Utility Board revealed that the e'lectrical meter located on the pole had been 'locked since January 15,1987. The Springfield Uti'lity Board's records also show a billing address of 870 South 43rd -for this meter number. The Lane County Assessment's records have no information for 870 South 43rd Street. A message received from the Springfie'ld Utility Board indicated that the meten was being removed from the property. An effort was made by staff to contact adjacent property owners and ask if they knovl when the'last mobile home was located on the property. One property owner was contacted and said that there has not been a mobile home on that property for at least 1. year. Mrs. Ruttencutter called on L2/4/87. lllrs. Ruttencutter said she spoke with Greg Mott when she originally applied and a'ledges she was told that even though the mobile home was gone longer than 90 days (possibly 5 months) she would have no problem replacing the unit. I exp'lained the procedure to Mrs. Ruttencutter and told her that Mr. Mott was willing to accept a date of July 15th (which is over 90 days, but allowing the benefit of doubt) and allow a replacement unit if one had been there sincethen. I told Mrs. Ruttencutter that I had discussed this issue with Mr. Mott and that he made no assurances to the approva'l of a mobile home that may have been removed for an indefinate period of time. I told Mrs. Ruttencutter that the Springfield Utility Board's records indicatethe electrical meter was locked off in January, L987. She said that soundedright because she had received notice in February that the previous tennant had moved his mobile home. DEC I SI ON This property does not qualify for the installation of a mobile home because(1) tnere is no record of any permits for the installaiton of a mobile home and(21 there has not been a mobile home on this property since at least January 1987.
