Ninth Sneet Cottage Grove, OR 97424 Nature of Request: Pursuant to Springfield Development Code (SDC) Article I l, the applicant is requesting an administrative modification of building setback provisions. The applicant wishes to reduce the five foot interior side yard setback required by SDC 16.050 to four feet. Location ofthe Propertv: The subject property is located at847 446 Place, in Springfield. The property is also known as Lot 128A of Lucerne Meadows Subdivision and Tax Lot 3900 on Lane County Tax Assessor's Map # l8-02-05-21. Site Information: The 6000 square foot property is zoned and desigrrated LDR on the City of Springfield ZonngMap. The subject site meets SDC Article 16 standards for lot size and dimension. The site is relatively flat and has no physical factors that limit development. A concrete building foundation has been poured on the subject site that is within four feet of the south property line. There is an existing residential structure on the lot south ofwhere the reduced setback is requested. The subject site and abutting property are currently under the sole ownership of the applicant. Staff Decision: Approval, as of the date of this letter Written Comments: Applications for Limited Land Use Decisions require the notification of property owners/occupants within 100 feet of the subject property, allowing for a 14 day comment period on the application. (SDC 3.080) No letters were received. Criteria of Approval SDC Section I L030( I ) states, " The Director may adjust any quantitative standard of this Code involving up to a 20%o percent reduction or increase not in conflict with other applicable standards provided that: (Findings in halics) (a) Locational or dimensional problems have been identified; A locational problem was identified when a concretefoundationfor a residential structure wasfound to hove been poured within 4 feet of the south property line. SDC 16.050 requires a residential structure to be setbackfwefeetfrom interior side yard property lines. (b) The proposed adjustment is the minimum/maximum necessary to alleviate the identified dimensional or locational problem; The requested adjustment is the muimum allowable under the provisions of SDC I1.030, however thefoundation is already poured. 2 ProfessionalMgt./Rawltns Modification of Provisions, PJ #98-01-03 - (c) The following adverse effects on neighboring properties will not occur as a result of this Modification of Provisions: l. creates demand for on street parking; The request is for a reduced setback along an interior side property line. The provision of 2 offstreet parking spaces as required by sDC 16.070 is unaffected and therefor no additional demandfor on-street parking would be created. 2. Increases noise, odor or dust; The request would reduce setback ofthe residential structure from five to four feet. No quantifiable increase of noise, odor or dust generated by standard residential use would result from the proposal. 3. Creates vision clearance area hazard for pedestrians, bicyclists or motor driven vehicles; Setback of the residential structurefrom public right of way is unaffected by the proposal; driveway spacing is not adversely afected. No vision clearance area is affected, therefor no trafic hazard is created. 4. Encroaches on solar access; Neither the height of the structure nor setbackfrom north property line are afected, therefore no solar access is encroached upon. 5. Creates a hazardous fire prevention or fre suppression situation. Thirteenfeet of separation is maintained between the proposed buildingfootprint and the uisting residential structure on the abutting property. NoJire hazard is created because the building separation exceeds Uniform Building Codes. (d) Public safety will not be compromised. The request is for a one foot reduction of side yard setbackfro,m an interior property line of a private residential lot. The request will not affect trafic orJire and life safety; there are no other public safety issues compromised.
