Meyers: 0n May 14, 1985, the City Building Safety Djvision 'issued you apermit for set up of your mob'ile home at 831/South 43rd Street, the south 80 feet of Tax Lot #8505, Assessor's Map #18-02-05-2i. Subsequent review by the City Engineering D'ivision revealed thatthe cost of instal'lation of the san'itary sewer serving thisparcel had been shared by Wayne A. and Sharon Ramey, and Pauland Margaret J. Haxby. To assure reimbursement for a portion ofthe sewer installation cost, the City and Haxby/Ramey enteredinto an agreement on June 8, 1970, which nequires that no sewerconnection be allowed to that port'ion of the sewer system unt'ilsuch property owner pays to the C'ity on behalf of Haxby/Rameythe sum of $q.37 per abutting front foot of the proper-ty mak'ingconnection. The City is then obligated to reimburse Haxby and Ramey their equal shares of the sum col'lected. With regard to your property, the sewer connection fee due basedon 80 feet of frontage is 80 feet x $4.37lsquare foot or$349.00. For your information, the current rate being chargedto propert'ies not obl i gated by a pri or agreement 'is $. 17 per square foot of property being served up to 150 feet deep, orin your case,80 feet x 150 feet x $.l7lsquare foot or $2,040.00. Even though it may not seem like it, since the original property owner did not 'inform you of this charge, you can see by the comparison to today's iate that this old agreement is certa'inlyto your benefit. It is my understanding that the facts are simply that the City has allowed another party or proPerty owner to tie in or connect to sewer service to the constructed sewer line without such party or property owner paying to Ramey and Haxby a sum of money equivalent to the properly prorated costs of $4.37 abutting front foot. (See paragraph 9 of Ag'reement, Project s-103). It would appear that the City owes Haxby and Ramey the sum of $4.37 per square foot, or the amount of $349.60. The position of the Meyers that in the absence of record notile the City has no right to collect this sum from them is incorrect. This is a sewer connection fee. Sewer connection fees, like other connection fees and construction and license fees, are not specified in the record notice. This is simply' not the type of charge that one would normally find to be included in record notice. Section 2-\O-9 of the Springfield Municipal Code provides for private sewer construction. It also specifically provides that in the event of any access to the sewer by other property owners ',the builder of the sewer shall be entitled to have refunded.to him the payment provided for in section 2-10-3" of the Springfield MuniciPal Code. Section 2-70-3 of the Springfield l"lunicipal Code provides for a sewer connection fee.!/ Please inform the Meyers of the existence of these two code sections and inform them further that in the event they do not pay, that the City of Springfield will take appropriate action Lo- en"rrre that they pay their fair share for the sewer servicing their propertyo Thank you for your attention to this matter.
