Re: Notice and Order to Comply With The Springfield Building Safety Code
Administrative Code Relative To The Unsafe And Substandard Buitding At 168 S.35th
Street #1, Springfield, Oregon
Dear Mr. Boltz;
As a result of a recent complaint, the City of Springfield Community Services Division,
Building Safety, has determined that the structure located at the above referenced
location, also known as Lane County Assessors Map #17-02-37-31, Tax Lot #06813, for
reasons below, a substandard and unsafe building as described in the Springfield Building
Safety Code Administrative Code. Lane County Assessment and Taxation records reveal
that you are the owner of this property.
Section 203 of the Springfield Building Safety Code Administrative Code classifies
structures, which are structurally inadequate or dangerous to human life as unsafe.
Section 1001 of the Housing Code specifies conditions constituting a substandard
building. The following conditions include but are not limited to conditions existing at
the structure identified above, classifying it as a substandard and unsafe building.
1. The property is not ctrrently served with electric service. Where there is electric
power available within 300 feet of the building, such building shall be connected
to electrical power supply.
2. The property is not currently served with water service. The Housing Code
requires that each residence shall be served with hot and cold running water
3. Each dwelling shall be provided with a water closet, lavatory, and a bathtub or
shoper. Although these fixtures are installed in the dwelling, the lack of water
service produces inadequafe and unsanitary sewage and plumbing facilities.
Section 204 (b)of the administrative Code provides procedures where the Building
Official may require vacation of the premises when cited deficiencies represent an
immediate hazardto life, limb, property or safety of the public or its occupants. Notice is
hereby served that the property is being posted to be vacated by 5:00 pm Monday, due to
the potential hazards to the occupants resulting from the above-cited conditions. If you do
not vacate the premise within the time frame specified, the City may seek compliance
with the Building Safety Codes through legal recourse, which may include Municipal
Court proceedings.
Once the property has been vacated, occupancy shall not take place until the above
mentioned unsafe and substandard conditions are corrected and approved by this office.
Any person having any record, title or legal interest in the building may appeal from this
Notice and Order to the Building Board of Appeals, provided that he appeal is made in
writing and filed with the Building Official within thirty (30) days from the date of
service of this Notice and Order. Failure to appeal will constitute a waiver of all right to
an administrative hearing and determination of this matter.

structure are 166 and 168 South 35th Street. There is no #1 , and there shouldn't be. Each side of the duplex is identified

Good morningl This is a difficult one. lt looks like it wasn't built all that long ago (in the 70's), but I can't find any record of it, at
alll The only thing I have on the address ... 168 #1 is a posting of a substandard structure in February of this year. I don't feel
comfortable telling you that by that letter, lwould validate the letter. I would like a little more time to look into it. lwould think in
the 70's the would not address a duplex #1 and #2, I would think they would assign their own street address numbers to the
units.
I just didn't want to leave you hanging much longer. I will try really hard to get an answer for you late today or tomorrow @

Hi Lisa,
Long time no contact!! Hope all is well over there in Springfield. Can you check the above address for me? We have somebody
trying to register there. She says it is a duplex with 168 S. 35th. RLID only shows 168 with numbers 1 and2 after it. The owner
is Gordon Boltz. lt is also interesting if you look at the bottom of the record in RLID it looks like it has combined the two
duplexes into one place. She said she has as 2 bedroom 1/zbalh whereas RLID shows 4 bedrooms 2 baths and 2 half
baths????
Should her address really be 166 S 35th or 168 S 35th???? Should one of them be using number 1 and the other number 2?
