Bates: Our records indicate that on March 20, 1998, you submitted plans for the proposed construction of a carport to be located at 4l I South 34s Street, Springfield Oregon. To date, the plans and required permits for this consffuction have not been obtained. The Springfield Building Safety Codes Administrative Code states that "Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the Building Official." The Code further states that, "The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon request by the applicant showing that circumstances beyond the conhol of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee." If you would like your plans returned to you, please'phone me within ten (10) days from the date of this letter and I would be happy to mail them to you. If I do not hear from you within ten (10) days, I will destroy the plans. If you have any questions, please feel free to phone me at 541-726-3790. Pennit 980343 Attn: Don Moore Per our conversation today" January 28, 1999 ln regards to the run-off tiom the gutter and downspout tbr our Carport that we are in the process of building: we have been authorized by the Citv of Springfield, to use "splash blocks' under the downspouts, which is consistent with the drainage on our residence. We have paid tbr the Drainage and Storm gutter charges assessed by the "City" tbr the Permit to build this carport so if there are an]'' problems arising in regard to drainage of water from our propertv, we will be able to revert the runoffwater to the City gutters as a remedy to that problem. The responsibitity of getting the water to the "City's" gutters willbe ours. HOWEVER we cannot accept t'ull responsibility beyond that, BECAUSE there are N0 Drainage or Stonn gutters to connect to. The only drainage for this property is a ditch along the dirt road which does NOT run anyplace, just sits there. There is no way we can hold the city completely harmless, for any problems arising after r,ve would get any surplus water otf our property and out to the road, since there is no provision b,v the city to drain any surplus water. On our own property, we will hold the "Cit_-u" harmless and accept that responsibility regarding our own propert-y.
