PETITION FOR ANNEXATION AND CONSENT
TO ANNEXATION
To: City of Springfield, Lane County, Onegon.

1. Real Property: The undersigned Petitioner(s) owns real propenty located
outs'ide the--eiTy-Ti-rnits, but I ocated w'ithi n the adopted Urban Growth Boundary
depicted'in the Eugene-Springfie'ld Metropo'litan Area General P1an, herein neferred to
as the Property and more particularly described'in Exh'ibit "A", attached hereto and
made a part hereof.
2. Irrevocable Petition and Consent to Contigqoql 44!qlg!i9n: The
Petitioner'(s) t'ion of
the Property to the City of Springfield pursuant to ORS 222.170. Petit'ioner(s)pet'itions, consents and agrees that the City Council in its sole discretion, now or
at any time heneafter, frdy adopt a resolution initiating contiguous annexation under
}RS 222.170 and oRS 199.490 (2) or any other state statute, a proceeding to annex the
Propenty to the C'ity. The Petitionen(s) consents to including'in such proceed'ing any
other property the City Council may direct or which the owner(s) have petitioned and
consented to the annexation.
Petitioner(s) understands, consents, and agrees that this
rnay be used by the City to meet the requirements of ORS 199.490

Petitioner(s) also inrevocably authorizes the City to present this Petition
and Consent to the Lane County Local Government Boundary Commiss'ion to init'iate any
minor boundary change under ORS 199.490 (i) as an interim measure to provide service
to the Property prior to its annexat'ion to the City.
In consideration for this Petition and Consent Agreement, the City agrees
that the Pet'iti oner (s ) Propenty may rece'i ve muni ci pal servi ces f rom the Ci ty and
Petitionen(s) may undertake the development of the Property in accordance with the
Springfie'ld Development Code and other applicable City p1ans, policies and standards
and with the requi rements of Lane County.
3. Binding on Successors: Petitioner(s) agree that Petit'ioner(s) and
Pet'itionen(s) hei rs thO successors in 'interest in the Propenty shall be bound by this
Petition for Annexation and Consent to Annexation which shall run with the Property,
and that not'ice of th'is document will be recorded by the C'ity in the deeds and
records for Lane County. A copy of the not'ice has been executed by the Petitioner(s)
and 'is presented herewith to the City.
4. New Use: Petitioner(s) must obtain City's approval for any new use, change
of use, orTn-tensification of use of the Property. The City will grant approval of
the use if it is in complrance with the Springfield Development Code and other
applicable p1ans, policies, and standards as interpneted by the C'ity.
5. Cost of Service in the Event Annexat'ion Denied: If an adm'inistrati veagency or court of competent 3urisdiction determines that the Property or part of it

Provision of Services:In executing this Petition and Consent it is
spec'if i cal ly understoodilat aqr annexation shall be contingent in its application toany particular annexation request upon the annexing City, w'ithin a logical andreasonable time, to provide key unban faci'lit'ies and services, includ'ing, whereapplicable, sanitary sewens, sol'id waste management, water service, fire protection,police protect'ion, parks and recreation pnograms, electrical service, land usecontrols, communication faci lit'ies, publ'ic schools on a district-wide basis ('in othen
words, not necessarily within walking distance of al.l students served), paved streetswith adequate provi s i on f or storm waten run-of f and pedestr"i an trave.l .
8. Applicat'ion: The City shal l not 'levy assessments, taxes or fees againstthe conselEfi'!-Tdii-clowner not app I i ed to properti es of simi I ar character throughoutthe rest of the City.

6. No Limitation on Fi rst Amendment, Rights: Although th'is Petit'ion forAnnexatlon Petitioner(s), and may be usedfor the purposes for which Petitioner(s) has agneed, nothing herein shall be
construed as 'lim'iting or inf ringing upon Pet'itioner(s)' right to speak out, commentupon, or present arguments regarding the adv'isabi lity of proceeding with the
annexation proceeding. It is specjfical ly understood by Petitioner(s) that in
executing th'is Agreement, a situation may arise whenein Petitioner(s) may be oppose<tto the annexation and would have all rights under the F'irst Amendment to articulatethat opposition but the Pet'ition and Consent of Petitioner(s) as contained hereinwi1'l be used for the purposes herein described by Clty in order to ach'ieve and
demonstrate comp.l'iance with ORS 199.490.
