Subject: Wetland Conservation and Drainageway Easement at Ambleside Meadows
Dear Ms. Neet,
This letter is being sent to inform you of the Wetland Conservation and Drainageway Easement
located on your property. This easement was created by the Ambleside Meadows Subdivision to
protect and preserve the wetland ecosystem known as the Irving Slough abutting your properly to
the west. The restrictions placed on this easement are outlined in the Declaration of Protective
Covenants, Conditions and Restrictions for Ambleside Meadows Subdivision (See attached
documents). These restrictions are in place to protect and preserve the integrity of the wetland
ecosystem and may be imposed through private or public enforcement. In general the following
activities are permitted in the area of the easement:
1. Individual homeowners may plant species associated with riparian areas as approved by
the Oregon Division of State Lands (See attached list).
2. Existing non-native vegetation may be removed by hand provided it is replaced with
approved riparian vegetation. For example, Blackberries and English Ivy may be
replaced with Salmonberry or Snowberry.
3. A tree deterrrined to be dangerous by a certified arborist may be removed.
The placement of temporary or permanent structures and storage sheds, fencing, lawn furniture,
vehicles, yard clippings in the easement area is prohibited.
The City of Springfield appreciates your cooperation in protecting and preserving this valuable

your attention is directed to Article VIII "Additional Easements
and Wetland.S," Section 5, "specific Restrictions Related to
Wetlands protection, EasemenE" Section A establishes a protective
25 foot buffer on Lot 25 through 34 adjacent to the wetland
boundary which was shown on your pIat. The buffer area is shown
on the plat. The buffer area has also been staked on your
property.
Subsect,ion (a) (2) requires thaE, 1ot owners maintain the buffer
area in its natural state with natural un-mowed vegetation. This
has not occurred. Your development of the property is impacting
the buffer area contrary to the requirements of the Protective
Covenants, Conditions and Restrictions.

are enforceable by the Corp of Engineers, the Division of State
Land.s, the City of Springfield, the Homeowners Association and
the owners of any lots that include the respective buffer areas.
In the event of a court proceeding for enforcement of these
restrictions, the losing party sha11 pay the attorneys fees of
the prevailing party or parties at triaI, oD appeal or petition
for review and, in enforcing or collecting any judgment, in such
reasonable amount as shal1 be fixed by the cour! in such
proceedings or in a separate action brought for that purPose.
The Declaration of Covenants, Conditions and Restrictions was
written to implement the requirements for the special conditions
for FiI1 permit No. !4947 which you received from the Division of
State Land. your attention is directed to Special Conditions No.
5 and 6 of that Fi11 Permit. The Covenants, Conditions and
Restrictions were also writEen to implemenE Nationwide Permit
t425 which you received from the Corps of Engineers. Please see
