RE: Fence at 597 Shelley Street, Springfield, 0regon (Job #832109)
Dear Terry,
I am writing regarding an inquiry which was made relative to the fence you recently
installed arormd your business at 597 Shelley Street, Springfield, 0regon.
Section 14.06 of the City Zoning Code states that on interior lots, a fence not
exceeding six feet in height may be. located anywhere on the lot except in the re-
quired front yard setback area where a fence not exceeding 3!', feet in height may
be located.
The zoning district in which your business is located (tlt{, Medium Industrial) re-
quires no front, side or rear yard setback, thereby allowing a six foot fence to
be constructed up to the front property 1ine. The City Developnent Coordination
Board, a staff review Board, has the authority to establish fence height and
setback linitations in addition to those stated above when warranted by'design
considerations such as vision clearance, compatibility of adjacent land uses, etc.
A chainlink fence, such as the one you constructed, does not create a vision clear-
ance problem and is therefore not regulated by the Board.
Since your fence incorporates three strands of barbed wire above the 6. foot high
chainlink portion, theie was a1.so a question regarding whether it satisfied the
Zoning CodL height linitation. This is not specifically addressed in the Code, so
the Board discussed the question at their last neeting. It was determined that the
barbed wire type fence installation is often justified in many Commercial and Indus-
trial situations where security is an issue, and should be allowed. During a Code
re-write, which is taking place, this issue will be clarified to alleviate future
misunderstandings regarding such fence installations
Our records will be updated to indicate that a final inspection and approval was
given to your fence which was installed under a City Permit Number 832109.
