Dear Mr. Pierce:
I am writing in regards to the sanitary sewer connection that was made to your property located at the
above referenced location. The property is also known as Lane County Assessors Reference Number
17023000, Tax Lot #01000.
ln February, in an emergency situation resulting from the recent flooding, a permit was issued to connect a
portion of the Pierce property to the municipal sanitary sewer system. It is my understanding that as a
result of the urgency presented to the staff person who assisted the permit applicant, the proper permit
review procedure was not followed for the permit you received. Once the permit was issued, it was
discovered that the "in lieu of assessment" in the amount of $3,499.30 was not collected. Also, the
applicable Systems Development Charges (SDC) that are payable on any property in the City when a
connection is made to the sanitary sewer system was not collected. The amount of the SDC that also
should have been collected is $638.42.
Although the fees are now due, I believe we can find a resolution that will best serve both you and the City
ofSpringfield. Sincetheerroroccurredbecauseofirnproperprocedurebeinglbllowedatthetimeol'
permit issuance, we are suggesting that the "in lieu of assessrnent" and the system development charges
that are due lbr this recent connection be payable either at the time of the irnprovement of the property, or
at the time the property is sold, which ever occurs first. lf you are agreeable to these terms, I will request
our legal council to prepare a contract for your signature and recordation at Lane County Records.

I am not familiar with all the background and conversations
behind the topic referred to in your Nlarcln 26, 1996 letter. I do
understand that this permit was not rout,ed correctly through the
normal City process. This may have been due to the expedited
"emergency" sj-tuation. f recall talking with Wa11y Miller and
Don Moore at the counter about t,he boundary Ij-ne between tax lot.
L7 02 30 00 01000 & 01800, and the old road alignment separating
these tax 1ots. The City records indicate that this o1d road
alignment is still public right-of-way. I do believe I mentioned
at the counLer that any sewer in t,he public right-of-way must be
constructed to Public Works const.ruction standards. Despite the
error made in t.he issuance of the permit, I have been directed to
fo1Iow up with three items that need t,o be understood and/or paid
for the hook-up to meet City Code.
The first item is the Systems Development Charges (SDC) which
total $538.42. f have explained this charge to A1 Pierce. This
charge is based on the number of plumbing fixture unit.s that
connected to the public sanitary sewer\see attachment). There
is no exception for this hook-up charge.\'lf these plumbing
fixtures are removed from the site, the current SDC methodology
will a11ow two years for the plumbing fixt.ures to be credited to
any new plumbing developmenE on t,he same properEy.

A1 Pierce made an agreement wlth the City of Springfield
maintenance division , Keith Miyata, to allow the inside drop
manhole connection to remain for only two years. This is not the
accepted City standard connection due to maintenance problems,
and will need to be corrected within two years(see at,t,ached
drawing) .
The t.hird item is the sanit.ary In-I-,ieu-of -Assessment charge which
is $3,499.30. The owner will be refunded this charge within five
years in the event that. the owner ext.ends the public sanitary
sewer to serve this property (see document).

Al-lan Pierce suggested I respond to your letter of May 8, 1-996. As
you may know, Mr. Pierce and I are t.he co-trusLees of the Pierce
Trusts which are the owners of the subject property.
The proposal in your letter of May 8, L996 is acceptable provided
we can reach an understanding about the inside drop manhole
connection. According to our conLractor, WaI1y Mi11er, plans
showing the installation were submitted to the city and approved.
This connection was made during a period of flooding when t.he
groundwater was at t.he surface. It would have been exceedingly
difficult to put in an outside drop. My understanding is the City
of Eugene accepts this inside drop procedure and the plan was
approved by Tom Poage.
We respectfully request. that a change in t.he drop be waived in view
of the extraordinary circumstances involved with regard to this
connection.

Allan Pierce and I are the owners, ds co-Trustees, of the Pierce
property located north of Marcola Road.
In FebrudEY, during the flood in an emergency situation, Mr. Pierce
called the- city ofiices to obtain a permit to connect a portion of
the Pierce property to the municipal sanitary sewers. In that
regard, enciosed i; a copy of the permit application. At that
tiie, $ZS.6O was paid to the city for the permi!.. Subsequently,
Mr. bi"rc" receivad a work sheet showing an additional charge of
9638.42. Absolutely no mention of this charge was made at the time
of the purchase of the permit. Mr. Pierce reasonably assumed
$75.60 covered the charges for connecting to the sewer. Under the
circumstances, it Seems unfair to now ask for a payment of more
than eight times the original perrnit fee. Based upon the
circumstlnces, objection is made to this additional charge.
Mr. pierce informs me that the contractor made the sewer connection
incorrectly under the rules of the City of Springfield even though
the conn"clion is one which the contractor has frequently nade in
the City of Eugene without a problem.. We understand that we have
a perio& of tw6 years to make corrections to this installation if
the same were necessarY.

We, the undersigned property owners, request permission to connect the following described
property to the sanitary sewer owned and maintained by the City of Springfield. We therefore agree to
pay a charge of $0.28 per square foot of the benefiting property for the first I 50 feet of depth as a deposit

user charges, connection fees, plumbing permits or other such costs to be assumed by the property
owner.
The applicant agrees to waive all right to remonstrate against an improvement project for
sanitary sewer to be duly initiated by the City Council, but not the right to protest the amount or
manner of spreading the assessment thereof, if the same shall appear to Applicant to bear inequitably
or unfairly upon said property of Applicant.
NOW THEREFORE, the City agrees that if Applicant complies with the terms of this
agreement and with all other applicable laws of the State of Oregon, Lane County, and the City, the
said Applicant shall be entitled to connect the existing residence to the public sewer systems.
The covenants herein contained shall run with the land herein described, and shall be binding
upon the heirs, executors, assigns, administrators, and successors of the parties hereto, and shall be
construed to be a benefit and a burden upon the property herein described. This agreement shall be
recorded in the Lane County Deed Records.
