RECITALS

WHEREAS, in consideration for Site Plan approval, the issuance of a
Building Permit, and the issuance of an 0ccupancy Permit, as specified in
tfre Springfield bevelopment Code Section 31.090, Applicant agrees to comply
witfr aIl the standards of the Springfield Development Code and Springfield
Municipal Code which may be appl icable to this develoDment project,
including but not limited to, the following:

Site Plan approval:

AGREEMENT
FINAL SITE PLAN. The app'licant has submitted a Final Site P'lan
in accordance with Section 31.080 of the Springfield Development
Code.

STANDARDS. The applicant agrees to fulfill all applicable
standards specified in the Springfield Deve'lopment Code and thespecific standards listed in RECITALS prior to occupancy, unless
certai n standards have been deferred to a I ater date in
accordance with Section 31.110 of the Springfield Development
Code.
CONDITIONS. The Appl icant agrees to ful fil I al I specific
conditions of approval required by the City listed in RECITALSprior to occupancy, unless certain conditions have been deferredto a later date in accordance with Section 31.110 of the
Springfield Development Code.
MODIFICATIONS. The applicant agrees not to modify the approvedFinal Site Plan without first notifying the City. Modificationsto the Final Site Plan shall be reviewed in accordance with
Section 31.100 of the Springfield Development Code.
5. MAINTAINING THE USE. The applicant agrees to the following:
(a) The building and site sha'll be maintained in accordance withthe provisions of the Springfield Development Code in order
to continue the use.
(b) It shall be the continuing ob'ligation of the Droperty ownerto maintain the p'lanting required by Section 31.140 of the
Springfield Development Code in an attractive manner free of
weeds and other invading vegetation. In addition, plantings
in the vision clearance area shall be trimmed to meet the 2L/2 foot height standard in accordance with Section 32.070of tne Springfield Development Code.
(c) Parking lots shall be maintained by the property owner ortenant in a condition free of I itter or dust, anddeteriorated pavement conditions shal 1 be improved to
maintain conformance with these standards.
( d) Undeve'l oped I and withi n the devel opment area shal I be
maintained free of trash and stored materials in a mowed andattractive manner. Undeveloped land shall not be used for
parking.
6.In addition to all other remedies which may be provided by law or
equi ty ( i ncl udi ng but not 1 imi ted to penal ties provi ded by
applicable state 'law or city ordinances) Applicant agrees thatCity may enforce Appl icant's responsibil ities by withhol ding
Aoplicant's Final Occupancy Permit, and terminating any Temporary
Occupancy Permit which may have been granted.
