On October 14, 1986, Willamette Graystone, Inc., an Oregon corporation (Willamette Graystone/Declarant) executed a Declaration of Restriction (Declaration) providing that the real property described on Schedule A, attached, could not be sold, improved, built upon, nor tuiiOing permits issued (restrictions) therefore until Centennial Boulevard, adjacent on the south, was impioved for two-thirds of its width to a point of entrance. The Declaration was recorded Novemter 3, 1986, Reception No. 86-44164, Reel 1428, Lane County Oregon Official Records. B. The Declaration was made in anticipation that the property described at Assessor's Map #17-02-30 Tax Lot 2000 would be partitioned into three parcels. The partition map was never submitted to the City of Springfield and the tentative approval previously granted expired. Tax Lot 2000 was not partitioned. Because the partition was not consummated, the restrictions are surplusage and should be terminated. C. The City of Springfield, by and through its Planning Director, desires to concur in termination of the restrictions. Willamette Graystone hereby declares: l. Declaration. On October 14, 1986, Willamette Graystone, Inc., an Oregon corporation (Willamette Graystone/Declarant) executed a Declaration of Restriction (Declaration) providing that the real property described on Schedule A, attached, could not be sold, improved, built upon, nor building permits issued (restrictions) therefore until the panhandle driveway shall be paved (24 feet minimum width) with the parcel addressed on the street. The Declaration was recorded November 3, 1986, Reception No. 86-44163, Reel 1428, Lane County Oregon Official Records. B. The Declaration was made in anticipation that the property described at Assessor's Map #17-02-30 Tax Lot 2000 would be partitioned into three parcels. The partition map was never submitted to the City of Springfield and the tentative approval previously granted expired. Tax Lot 2000 was not partitioned. Because the partition was not consummated, the restrictions are surplusage and should be terminated. C.
