for that permit, the plan reviewer neglected to include the complete lo/o State Surcharge

for this project. I am enclosing a copy of the permit that was issued and a copy of the
original receipt for your reference.
Please pay the amount due prior to requesting your final inspections for this project. I
have enclosed a prestamped envelope for your convenience if you wish to make payment
by mail, or you are welcome to make payment in person at our office. Our office hours
are 8:00 a.m. - noon and from 1:00 p.m. - 3:00 p.m. Monday through Friday. I sincerely

MINIMUM DEYELOPMENT STANDARDS
DEVELOPMENT AGREEMENT
This DEVELOPMENT AGREEMENT, hereafter "Agreement", is entered into this day of
March,2003 (the "Effective Date") by and between the CITY OF SPRINGFIELD, hereinafter "City",
and Springfield Utility Board hereinafter "Applicant/Owner", in accordance with Section 31.010(5), and
Section 3.070(3).
RECITALS
WHEREAS, on the day of March,2003, the City approved the Minimurn Development
Standards Application submitted by the Applicant for the purpose of the following:
CITY JOURNAL NUMBER DRC2003-00005, Type I Minimum Development Standards to
place a water pump station building.
WI-IEREAS, in consideration for a Typc I Mininrum Development Standards Application
approval, the issuance of a Building Permit, and the issuance of an Occupancy Permit, as specified in llre
Springfield Development Code Section 31.090, Applicant/Owner agrees to con.rply with all of the
standirds in the Springfield Development Code and the Springfield Municipal Code whicli ntay be
applicable to this development project unless modified or excepted by the Minimum Developnrent
Siandards Development Agreement, Development Services Director, Planning Comnlission, Building
Official or their agents, orihe Fire Marshall, which modifications or exceptions shall be redlced to
writing. )
WHEREAS, in consideration for Minimum Development Standards approval, the issuance of a
Building permit, and the issuance of an Occupancy Permit, as specified in the Springfield Development
Code Section 3 I .010(5), Applicant/Owner agrees to cornply with the following specific conditions
imposed by the City as part of th" Minir-,um Development Standards approval:
l. All improvements must be constructed/installed or bonded as shown on the Final Plot Plan
dated January 23,2003-
Z. All conditions specified in the Notice of Decision, dated March 20,2003 must be fulfilled
prior to the issuance of a Final Occupancy Pernrit'

3. CONDITIONS. The Applicant/Owller agrees to fulfitt all specific conditions of approvat
required by the City listed in the RECITALS prior to occupancy, unless certain conditions have been
deferred to a later date in accordance with Section 3 I .010(5Xb) of the Springfield Development Code.
4. MAINTAINING THE USE. The Applicant/Owner agrees to the following:
(a) The property shall be maintained in accordance with the provisions of the
Springfield Development Code in order to continue the use.
(b) Oil/water separator catch basins, if approved by the City, and other drainage systems
are required to be checked and cleaned to remove pollutants as needed (at least once a year, usually. in
September). AII waste material nrust be disposed of in a lawful manner. The Applicant/Owner must
dotument these n'raintenance activities and havc the documents available on site for the City of
Springfield to inspect and review.
6. In addition to all other remedies whicli may be provided by law or equity (including but not
lirnited to penalties provided by applicable State Law or City Ordinances), Applicant/Owner agrees the
City may enforce Applicant/Ownei's responsibilities by withholding Applicant's Final Occupancy
permit, and terminaiing any Tenporary

Permit which may have been granted.
7. Any FinalMinimum Development Standards approvalbecomes null and void if construction
does not commence within 90 days of the date of the agreement, unless provisiotls have been made as per
Article 31.010(5) of the Springfield Development Code'
