To Whorn it May Concern: As a result of a recent inspection, the City of Springfield Community Services Division, Building Safety, has determined that the structure located at the above referenced location, also known as Lane County Assessors Map # 17033613 Tax Lot 07300, for reasons below, is considered a substandard and unsafe building as described in the Springfield Building Safety Code Administrative Code. Lane County Assessment and Taxation records reveal that you are the owners/tax payer of this property. Section 203 of the Springfield Building Safety Code Administrative Code classifies structures which are structurally inadequate or dangerous to human life as unsafe. Section 1001 of the Springfield Housing Code specifies conditions constituting substandard buildings. The following conditions include but are not limited to conditions existing at the structure identified above, classifying it as a substandard and unsafe building. l. Any building or portion thereof, including any dwelling unit, guest room, or suite of rooms, or the premises on which the same located, in which there is existing any two or more of the following listed conditions, to any extent that it endangers life, limb, health, property, safety, or welfare of public or the occupants thereof shall be deemed and hereby is declared to be a substandard building: A) Lack of heating throughout building. Heat shall be maintained at 68 degrees three feet out from wall three feet up in each habitable room B) Lack of kitchen sink, C) Lack of electrical lighting D) Dampness of habitable rooms due to lack of maintenance E) General dilapidation or improper maintenance 2. Substandard Hazards: A) Defective or deteriorated flooring or floor support B) Flooring or floor supports of insufficient size to carry imposed loads with safety C) Members of walls, parlitions, or other vertical supports that split, lean, list, or buckle due to defective materials or deterioration or that are of insufficient size to carry loads with safety. D) Members of ceilings, roofs, ceiling and roof supports, or other horizontal members which sag, split, or buckle due to defective materials, deterioration or are insufficient size to carry load Section 204 (b) of the Administrative Code provides procedures where the Building Official may require vacation of the premises when cited deficiencies represent an immediatehazard to life, limb, property or safety of the public or its occupants. Notice is hereby served that the property will be posted to be vacated by 1:30 p.m. Friday 212612016 due to the potential hazards to the occupants resulting from the above cited conditions. If you or your tenants do not vacate the premises within the time fiame specified, the City will seek compliance with the Building Safety Codes through legal recourse, which may include Municipal Courl proceedings. Once the property has been vacated, occupancy may not take place until the above mentioned unsafe and substandard conditions are corrected and apploved by this office. Any person having record, title or legal interest in the building may appeal from this Notice and Order to the Building Board of Appeals, provided that the appeal is made in writing and filed with the Building Official within two (2) days from the date of service of this Notice and Order. Failure to appeal will constitute a waiver of all right to an administrative hearing and determination of this matter. Your anticipated courtesy and cooperation is appreciated.
