Re: Defective/Improper Sewage Disposal at MTL 18-03-03-122900
Dear Ms. Monroe:
As you are aware, the septic system that serves your residence is defective and allowing
untreated sewage to discharge onto the ground creating a potential health hazard to you
and adjacent property occupants and/or users. Section 3103 of the Oregon One and Two
Family Dwelling Code (DC) provides in part:
Its shall be unlawful for any person to cause, suffer, or permit the disposal of
sewage, human excrement, or other liquid wastes, in any place or manner, except
through and by means of an approved plumbing and drainage system, installed and
maintained (emphasis added) in accordance with the plumbing provisions of this
Cdde.

Oregon State Law also requires where a public sewer system is both legally and
physically available within 300 feet, replacement of an existing private septic system is
not allowed and connection to the public sewer system is required.
We are both aware from past correspondence and available Lane County records that the
septic system's failure didn't occur just recently. However, the City cannot allow this
potential health hazard to continue. Correction of the failed septic system must occur
within thirty (30) days from the date of this letter or the property shall be vacated until
connection to the public sewer is completed.
I am very aware of the potential costs to you in correcting this condition and the steps
that must be satisfied before final resolution can occur. The City and County will try to
provide as much assistance with the process as we possibly can. However, much of the
continued effort and cost will be your responsibility.
Although there are many qualified contractors within the area that can give you a cost
estimate for connection to the sewer if an easement can be obtained from the west
property owner, I have included the names of four firms that perform this type of work in
our area. Please understand that I'm not recommending these firms, but have only
included them for your convenience. Other licensed contractors can be found in the
phone directory under "plumbing contractors".

We have also contacted the property owner west of your property about the possibility of
their granting you a sewer easement to cross their property. We are currently preparing a
map for the proposed easement and a legal description of the proposed easement for their
review. We will be doing this concurrently with your effort in obtaining estimates from
private contractors for the work that needs to be performed. If we can obtain an easement
for the sewer work, we will then ask for your signature for consent for annexation.
We are also investigating if there are any low interest loans or emergency repair
programs that may be able to provide financial assistance for the sewer installation. We
will assist you in getting the information on the programs and checking to see if you're
eligible.
There is a significant amount of work to do in a short period. I sincerely hope we can
resolve this problem within thirty days so that vacating the property does not become
necessary.
