Salem, Oregon 97305 Subjeet: Results of Site y 2, 1"987 for Sherman- ournal Number 87-06-86 Dear Mr. Uyant: This letter summarizes the results of the subject meeting regarding your site plan submittal for the property located at 1522 North LBth Street, Assessor's Map 17-03-25-3L Tax Lot 7000. Site Plan approval has been granted vith the folloving conditions. AII items folloved by an asterisk must be shovn on the Final Site PIan. 1. A signed, recorded, joint use parking and access agreement betveen Sherman-llilliams Paints and McDonald's Corporation must be submitted to this office Z. One bieycle rack is required for the development in accordance vith Section 31.190(9) of the Springfield Development Code'* 3. If an outside trash receptacle is to be used it must be screened in accordance vith Section gt.OOO(:) of the Springfield Development Code.* 4. Either a demolition permit or house move Permit needs to be obtained for the removal of the existing house. Journal Number 86-06-86 VHEREAS, in consideration for Site Plan approval, the issuance of a Building Permit, and the issuance of an Occupancy Permit, as specified in the Springfield Development Code Section 31.090, Applicant agrees to comply vith all the standards of the Springfield Development Code and Springfield Municipal Code vhich may be applicable to this development project, including but not limi.ted to, the following: L. NOV THEREFORE IN CONSIDERAT]ON OF THE FOREGOING RECITALS I,IHICH ARE EXPRESSLY MADE A PART OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS FOLLOIIS: AGREEMENT 1. FINAL SITE PLAN. The applicant agrees to submit a Fina1 Site PIan in accordance with Section 31.080 of the Springfield Development Code concurrently vith this Agreement. The applieant agrees to fuIfi11 aII applicable standards specified in the SpringfieLd Development Code and the specifj.c standards listed in RECITALS prior to occupancy, unless certain standards have been deferred to a later date in accordance vj.th Section 31.110 of the Springfield Development Code. 3. CONDITIONS. The Applicant agrees to fu1fi11 a1l specific conditions of approval required by the City listed in RECITALS prior to occupancy, unless certain conditions have been deferred to a later date in accordance vith Section 3L.110 of the Springfield Development Code. 4. MODIFICATIONS. The applicant agrees not to modify the approved Final Site PIan vithout first notifying the City, Modifications to the FinaL Site PIan shall be revieved in accordance vith Section 31.L00 of the Springfield Development Code. 5. MAINTAINING THE USE. The applicant agrees to the folloving: (a) The building and si.te shall be maintained in accordance vith the provisions of the Springfield Development Code in order to continue the use. (b) It shal1 be the continuing obligation of the property ovner to maintain the planting required by Section 31.140 of the Springfield Development Code in an attractive manner free of veeds and other invading vegetation. In addltion, plantings in the vision clearance area shall be trimmed to meet the 2 1,/2 foot height standard in accordance vith Section 32,070 of the Springfield Development Code. (c) Parking lots shall be maintained by the property ovner or tenant in a condition free of litter or dust, and deteriorated pavement conditions shall be improved to maintain conformance vith these standards. (d) Undeveloped land vithin the development area shall be maintained free of trash and stored materials in a moved and attractive manner. Undeveloped land shall not be used for parking. 6. In addition to all other remedies vhich may be provided by Iav or equity (including but not limited to penalties provided by applicable state lav or city ordinances) Applieant agrees that City may enforce Applicant's responslbilities by vithholding or terminating Applicant's Occupaney Permit. Site Plan Development Agreement 2 () 7. Any Final Site PIan approved becomes ntrll and void if construction does not commence within one year of the date of this Agreement.
