VHEREAS, the intendbd development improvement is of a nature that requires noother reviev approval from other State or local agencies and is'exempt from thecriteria established by the Building Safety Division, attached as exfribit A ofthis Agreement
WHEREAS, the City has not revieved or approved the submitted materials for the
development improvement, the City is theiefore unable to confirm at this timevhether the permit applicatic: submitted vilL be approved, and vhether therequired construction permits can be issued.

VHEREAS, the Epplicant has requested th6 City to provide expedited authorizationto proceed vith-certain phases of construction prior to the completion of theCity's reviev of the permit application.
IIH.ERE4S,.the gity's fee for the administrative services rendered in providing
expedited authorization is $150.00.
N01J, THEREFORE, in consideration of the foregoing recitals and of the mutualpromises contained herein, the City authorizes immediate commencement of the
development improvement specified in the permit application subject to thefolloving terms and conditions:

1. City agrees that the Applicant may immediately commence vith the
development improvements set forth in the permit apprication. city,sauthorization to proceed is conditione! hovever, upon Applicant's agreementthat the project vill be constructed as set forth- in thl attached iubmitteddravings and specifications, except as may be modified by city, and vitl

2. City agrees to reviev Applicant's. permit application in the normal reviev
process and to thereafter:
a) issue Applicant the appropriate construction permits; 9I
b) advise Applicant of deficiencies in the proposed construction vhich
must be renedied before permits can be issued; or
c) advise Applicant of any statutes, ordinances or code provisions vith
vhich Applicant must comply vith before City can issue the permit.
3. Applicant agrees that if City finds Applicant's permit application and
submitted naterials inadequate or deficient in any nErnner including.but notlinited to, the application or the proposed construction do not comply vithall applicable statutes, ordinances or code provislons, Appllcant v111
expedltlously cure the deflclencies so that the Clty nay issue the requiredpermits. Should Appllcant fatl to expeditiously correct submltted naterials,or should correction prove inpossible, City may in it's discretion, take anyor all of the .folloving actions:
a) stop all further construction of the project in the manner prescribed.in the Springfield Building Safety Code Administrative Code (BSCAC),

receipt of such notice, Applicant shall immediately remove. the vork
specified in the Notice and 0rder
4. Applicant agrees, if the issuance of the permit is denied:
a) to remove, at the Applicant's sole cost and expense, a1I completed
construction or improvements; and
b) to restore the site or structure to it's pre-agreement condition and
free of all hazards

Purpose
. The PurPose of this agreement is to a11ov'certain development improvements tooccur prior to.obtaining plan reviev approval frorn the Springfieia co**unity'Services Division.
Scope
The use of this agreement shall be limited to certain one and tvo-familydvellings not complex in nature as determined by the Building 0fficial andminor alterations or nodifications to existing tommercial "ni indu"trialbuildings vhich are of a non-structural'type Ind do not adversely affect anystructural member of the building or any pirt of the building having fireresistant construction.
One and tvo-family dvelling plans for structures that are complex in nature thathave been prepared-by an Oregon licensed architect or engineei and accompanied.by a letter of reviev prepar-d by said architect or engiieer, stating thit thesubmitted material is in compliance vith the one and tio-ramily DueliingSpecialty code, nay be considered erigible for this agreenent.
The folloving iterns include but are not limited to certain conditions ofdevelopment identified as ineligible for tiris agreement:
a) developnent requiring site approval vhich has not been obtained i
b) nev development rocated on rand vith over six-percent slope;
c) lots having expansive (c1ay) soil;
d) development located vithin flood hazard area.s;
e) development located vithin vetland areas;
f) pole buildings or other such type of structure that is ngt of eonventionalconstruction.
