IIHEREAS, the applicant has applied ro the City Community Services Building
ur
Assessor's Hap and Tax Lot number
VHEREAS, the applicant has asked the City to authorize the Applicant to
imruediately commence development improvements vithout a completed plan reviev or
subsequent approval as required by the Springfield Building Safety CodeAdministrative Code section 303(a)
YHEREAST 'the Applicant has submitted to the City a cornpleted permit appllcation,3 (three) sets of'construction dravings, specificationi, and other daii requiredfor the City to complete the necessary plan reviev of the proposed development
improvement.
VHEREAST the intendbd development improvement is of a nature that requires noother reviev approval from other State or local agencies and is exempt from thecriteria established by the Building Safety Division, attached as Exhibit A ofthis Agreement.
WHEREAST the City has not revieved or approved the submitted materials for the
development improvement, the City is therefore unable to confirm at this timevhether the permit applicatlc: submitted vill- be approved, and vhether the
Iequired construction permits can be issued.
IIHEREAS, the Epplicant has requested th6 City to provide expedited authorizationto proeeed vith certain phases of construction prior to the completion of theCity's reviev of the permit application.
IIHEREAS, the City's fee for the administrative services rendered in providing
expedited iruthorization is S150.00.
NO\J,.THEREF0RE, in consideration of the foregoing recitals and of the mutual
promises contained herein, the City authorizes immediate commencement of the
development improvement specified in the permit application subject to thefolloving terms and conditions:

1- C_ity agrees that the Applicant may immediately commence vith thedevelopment improvements set forth in the permit apprication. city,sauthorization to proceed is conditioned hovever, upon Applicant,s agreementthat the project viII be constructed as set forth- in tirl attached iubmitteddravings and specifications, except as may be modified by city, and vill
comply vith all applicable lavs and ordinances. Applicant,s ionediate

2. City agrees to reviev Applicant's. permit applicagion in the normal reviev
process and to thereafter:
a) issue Applicant the appropriate consrruction permits; 9I
b) advise Applicant of deficiencies in the proposed construction vhich
must be remedied before permits can be issued; or
c) advise Applicant of any statutes, ordinances or code provisions vith
vhich Applicant must comply vith before City can issue the permit.
3. Applicant agrees that if City finds Applicant's permit application and
submitted materials inadequate or deficient in any manner including.but not
Iimited_ to, the application or the proposed construction do not comply vithall applicable statutes, ordinances or code provisions, Applicant vi}l
expeditiously cure the deflciencies so that the City may issue the requiredpermits. Should Applicant fail to expeditiously correct submltted materials,or should correction prove impossible, City may in it's discretion, take anyor aII of the folloving actions:
a) stop all further construction of the project in the manner prescribedin the Springfield Building Safety Code Administrative Code (BSCAC),

b) order disconnection of serving utilities in a manner as prescribed in
BSCAC, SECTToN 201 (f)
c) issue a NOTICE ]j') OP.DER for renoval of all such ro::!: in a manner as
prescribed in BSCAC, SEC-TION 204. ABATEHEI{T OF UNSAFE, SUBSTAI.IDARD 0R
DAI{GEROUS BUILDfNGS, STRUCTTFGS 0R BUILDING SERVICE EQUIPHEM. Uponreceipt of such notice, Applicant shall immediately remove the vorkspecified in the Notice and 0rder.
4. Applicant agrees, if the issuance of the permit is denied:
a) to remove, at the Applicant's sole cost and expense, all completed
construction or improvementsl and
b) to restore the site or structure to it's pre-agreement condition andfree of all hazards
or construct

Purpose
The purPose of this agreement is to allov'certain development improvementsoccur prior to obtaining plan reviev approval from the Springfield CommunitServices Division.
Scope
The use of this agreement shall be limited to certain one and tvo-familydvellings not complex in nature as determined by the Building.0fficial and
minor alterations or modifications to existing commercial and industrialbuildings vhich are of a non-structural"type and do not adversely affect anystructural member of the building or any part of the building having fireresistant construction.
One and tvo-family dvelling plans for structures that are complex in nature that
have been prepared by an Oregon licensed architect or engineei and accompanied.by a letter of reviev prepared by said architect or engineer, stating thit the
subruitted material is in compliance vith the One and Tvo-Family DwellingSpecialty Code, may be considered eligible for this agreement.
The folloving items include but are not limited to certain conditions of
development identified as ineligible for tiris agreement:
a) developnent requiring site approval vhich has not been obtained;
b) nev development located on land vith over six-percent slope;
c) lots having expansive (cIay) soil;
d) development located vithin flood hazard areas;
e) development located vithin vetland areas;
f) pole buildings or other such type of structure that is not of conventional
cons truc tion.
