Smith, was required to address a nuisance abatement order from DEQ for a failed septic system. Property could not be served by sanitary sewer. A single family house and single wide manufactured home were located on the property. The house was demolished and the manufacture home removed. The Development Code (SDC 5.030(5)) allows a single wide to be replaced on the lot, which would otherwise be unlawful, provided the replacement is completed within 90 days. The single wide manufactured home was not replaced within 90 days. The applicant is granted the grace period to allow the replacement of the single wide for the following reasons: l. The City did not have jurisdiction over the agencies empowered with approving a replacement septic system on this parcel. 2. Lane County and DEQ found that a standard replacement system would not work and required the applicant to engineer a unique alternative system which took six months to engineer, design and the receive county and state approval. 3. The approval was granted during the winter and the system, by its design, could not be installed until the soil was dry.
