RE: Legal Non-Conforming Status of 640 l0th Steet, in Springfield. J. Norton Cabell, owner.
Dear Mr. Jewett,
I have considered the records, permits and signed statement presented as proof that the fourplex at the
above mentioned address existed prior to the original application of single family residential zoning in the
1940s. The evidence presented consistently places the construction of the structure in the same era. Given
the amount of time that has passed, the issuance of City permits and the close proximity of data presented
to the zoning implementation date, I am inclined to accept the information as reasonable proof that the use
predated the zoning implementation date or was legally created. Subsequently, I find sufficient cause to
acknowledge the legal non-conforming use status of the property. The designation of legal
nonconforming use status is subject to provisions and limitations of Springfield Development Code Article
5, which are still consistent with the provisions of the original zoning code. Please refer to the attached
Article 5 for information regarding future maintenance and improvements.
Please advise your client that maintenance activities in accordance with SDC Article 5 are not considered
an expansion of use and are strongly recommended. The number of units in the structure must be corrected
on the Lane County Tax Assessor's roles at your clients earliest convenience to avoid possible confusion in
the future.
