Note: Oregon Law, ORS 701.055(4) requires residential construction permit applicants who are not

permit can be issued. This statement is requiredfor residential building, electrical, mechanical and
plumbing permits. Licensed architect and engineer applicants, exemptfrom licensing under
ORS 701.010(7), need not submit this statement. This statement will be filed with the permit.

DRC2005-00088 approved a variance to allow building setback of 16"3" for a garage
located at2272- 9th Street.
The appeal period for this application will be over at the end of business on January 30,
2006
Springfield Development Code Section 3.080(6) states that "Any action taken to begin
development prior io the expiration of the appeal period is solely at the applicant's risk
and expense. The City assumes no liability or expense if the development is ultimately
terminated based upon the outcome of the appeal".
I understand the above statement in SDC 3.080(6) and take full responsibility, risk and
expense in continuing my garage project under building permit COM2005-01063 before
the end of the appeal period. I acknowledge that the City of Springfield assumes no
liability or expense if the variance is appealed and the decision is reversed.
