My understanding of the situation is that originally a replacement sewer line was being installed outside the home. Then, Mr. Muller determined that the existing plumbing in the bathroom was defective and needed replacement. Upon requesting permit information from this office for the additionalwork, Mr. Muller explained that the three fixtures, a tub, toilet and lavatory sink, were located in an area which measured five feet by five feet in size. Mr. Al Ward, the City's Permit Review Technician advised Mr. Muller that the space is inadequate for the functional use of the three fixtures. He informed Mr. Muller that the replacement of the plumbing system piping for the bathroom would also require adequate space for use of the plumbing fixtures. Essentially, the room would have to be enlarged if all three plumbing fixtures were to remain. The OTFDSC requires that replacement or modification of any structural, mechanical, electrical or plumbing system in a building must comply with present Code requirements. One such requirement is that a clear area, 30" wide and 21" deep must be maintained in front of a toilet (OTFDSC Sec.307.2 and Fi9.307.2). Once the existing plumbing is removed, the replacement piping cannot be installed in the same manner that would prevent the required clearance at the toilet. lf the existing piping for the plumbing fixtures had not been replaced or modified, the forgoing Code requirement would not apply.
