Dear Ms. Lee: I recently met with you at the above property t$ determine whether dny requirements or restrictions of City,/State Codes would apply to the existing conditions on the property. You were particularly concerned that the south eave line of the building extends approximately one foot into the alley right-of-way. You also mentioned that a potential buyer of the property may wish to alter or add to the structure, or install site improvements, which may require approval by the City. With regard to the alley encroachment, the City, at the present time, has no plans for improving the aliey. Improvements to the alley may be scheduled at the request of a majority of the adjacent property owners, or if access should be required by new development adjoining the alley. Removal of the encroachment may be required in the event of such improvement, or if utility improvements are to be made in the aiiey where the encroachment represents a hinderance or iiability to the installing contractor or the pubiic. The building is presently regarded as non-conforming (to codes) because it is located on or near property lines without proper fire protection of the walls and openings. Any proposals for buiiding improvements which will increase the potential hazard or the number of occupants in the building will require the non-conforming condition to be corrected. The above property is located in the IYashburne l{istoric District of Springfield. Although the structure is not designated as historically significantly, all proposed improvements and alterations to the property which require a building permit will also require review and approval by the Historical Commission, possibly involving a public hearing. Building and site improvements may be made to the property through the normal building permit application process at this office. Permits are not required for decks or uncovered porches which are less than 30 inches above the adjacent ground elevation, but fences do require a permit. During our visit we noted that off street parking is not presently provided on the site. The City Development Code requires two paved parking spaces for each single family residence.
