licensed with the Construction Contractors Board to sign thefollowing statement before a building
permit can be issued. Ihis statement is requiredfor residential building, electrical, mechanical and
plumbing permits. Licensed architect and engineer applicants, exemptfrom licensing under
ORS 701.010(7), need not submit this statement. This statement will befiled with the permit.

Construction Contractors Board in accardance with ARS 7A1.A55(5J, passed bythe 19Bg Oragan Legislature.
If you are acting as your own contractor to construct a new home m make a substantial improvement to an existing
structure, you can prevent many problems by being aware of the following responsibiiities and concerns.
Employer Responsibilities
You will, in most instances, be ruled to be an "employer" and the contractors you contract with will be "ernployees" if
you use contractors not licensed with the Construction Contractors Board to do labor in constructing or to assist in the
construction or irnprovement of a residential $tructure. As the employer, you must comply with the fotlowing:
()regon's Withholding Tax Law: As an employer, you must withhold income taxes from employee wages at the time
employees are paid. You will be liable for the tax payments even if you don't actually withhold the tax &om your
employees. For a State Business ID number, call the Business Informatipn Center at 503-985-2200.
Unemployment Insurance Tax: As an employer, you are required to pay a tax for rmemployment insurance purpop6,.
on the wages of all employees. For more information, call the Oregon Ernployment Departmentat 503-947-1488. -{-
Workers' Compensation fnsurance: As an employer, you are subject to the Oregon Workers' Compensation Law,
and must obtain workors' compensation insurance for your employees. If you fail to obtain workers' compensation
insurance, you could be subject to penalties and be liable for all claim costs if one of your employees is injured on thejob. For more information, call the Workers' Compensation Division at the Department af Consumer and Business

U.S' Internal Revenue Service: As an employer, you mllst withhold federal income tax from employees' wages.

Other Responsibilities and Areas of Concerns
Code Compliance: As the permit holder for this project, you are responsible for resolving any failure to meet code
requirements that may be brought to your attention through inspections.
Liability and Property Damage fnsurance: Contact your insurance agent to see if you have adequate insurance
coverage for accidents and omissicns such as falling tools, paint over spray, wats damage &om pipe punctures, frre or
work that must be redone.
Time: Make sure you have sufficient time to supervise your employees.
Expertise: Make sure you have the skills to act as your own general conffactor, to coordinate the work of rough-in
and finish trades, and to notifu building officials as the appropriate times so they can itrform the required inspections.

remain valid, the work which has been authorized by the permit must begin within t 80 days of the date
of issuance, and an inspection must be requested at least every 180 days.

RE: Composting Toilet Permit Request
Dear Ms. Sampson,
I have reviewed all your submitted information regarding the composting toilet and
contacted the State Building Codes Division Plumbing Section regarding your proposal.
Your request for the installation of a composting toilet in your residence cannot be
approved for the following reasons:
The Springfietd City Code, Section 3.350 requires a person erecting or maintaining a
water closet, sink, bathtub, or drain in the city upon property within 300 feet of any
public sanitary sewer shall connect the facility with the sewer at his own expense, in the
manner and under regulations and supervision prescribed by the city.
Also, Springfield City Code, Section 4.302 except as section 4.308 provides to the
contrary, it shall be unlawful to install a septic tank or other private sewage disposal
system within the city after the effective date of this code. (Recodified in November
t997)
Section 4.306 of the Springfield City Code states Except as Section 4.308 provides to the
contrary, no person shall use or allow on premises under his control any privy other than
a temporary one that is necessary for a construction project and is consffucted and
maintained in accordance with standards of the Deparfrnent of Environmental Quality.
I am attaching a copy of the above mentioned City Code Sections for your reference and
information.
Also, after speaking with the State Building Codes Division, it is their understanding that
once a composting toilet is installed, a periodic inspection of the unit is required by either
the State Plumbing lrspector or by the local jurisdiction where it is installed. The State
inspector said they do not have the staff to perform periodic inspections of these units
within local jwisdictions, only in rural areas. For the City to provide periodic inspection

services, an ongoing inspection fee would be required. The City's standard per hour
inspection fee is $45.00. A minimum of trvo inspections per year would be required.

3.304 Repair-Duty of City Council. The
council, acting through the city manag-
er, shall maintain in a state of good repair all
sidewalks within the city, hfter the manager is
notified of any repair needed upon an existing
sidewalk in the city. The city manager shall
not be deemed to have notice of a sidewalk
needing repair until the needed repair has been
made known to the manager in writing.
3.306 Repair-Duties and Liabilities of
Property Owners. It shall be the duty
of all property owners, including record own-
ers and contract purchasers, or both, to keep
all sidewalks in front of and abutting and ad-
joining their property clean and in good repair.
All property owners shall be required to keep
the sidewalks abutting upon their property free
and clear of any defects, obstructions, and
hazardous materials. Failing in such duty,
they shall be liable to any person injured
thereby.
3.308 Repair-Notice to Owner of Abutting
Property. Whenever the city manager
has cognizance of any required sidewalk re-
pair, he shall thereupon give notice in writing
to the record owner of the real property adja-
cent and abutting upon the sidewalk that re-
quires repair, and a copy of such notice shall
be sent by regular mail to the occupant of the
premises located upon such property, if there
be any, advising that the sidewalk must be
repaired to the satisfaction of the public works
director within l0 days from the date of the
notice or within such additional time as the
public works director specifies, and that if the
property owner fails to repair such property
within tan days, immediately following the
notice aforernentioned, then the city manager
shall cause the sidewalk to be repaired forth-
with.
3.310 Repair-Collection of Costs. Each lot
or part thereof or parcel of land sha[
be liable for the full cost of repair or recon-
stnrction of any sidewalk in front of and abut-
ting upon it. - Upon the completion of any
sidewalk repair or reconstruction by the city as
provided herein the city mimager shall present
the billing therefore to the city councit ana the
city council shall, by ordinance, assess upon
each lot or parcel of land liable thercfore its
appropriate share of such cost and direct that
such assessment be entered as a lien on the
docket of city liens in the manner provided by
law. If the assessment is not paid within 30
days after notice thereof, which notice shall be
made by the city finance director by regular
mail to the same person or persons who were
originally notified for the defective sidewalk,
the council may proceed to levy upon such [ots
or parts or parcel thereof liable for zuch as-
sesiment, and cause the lien'thereof to be
satisficd by execution ind sale in the manner
provided by the charter and ordinances of the
city, or by statute of the state for the collection
of delinquent assessments for the improveruent
of streets.

3.350 Sewer Connections. A person erecting
or maintaining a water closet, sinh
bathtub, or drain in the city upon property
within 300 feet of any public sanitary sewer
shall corurect the facility with the sewer at his
own expense, in the manner and under rcgula-
tions and supervision prescribed by the city.
3.352 Sewer Connections-Permits. No
unauthorized person shall uncover,
make any connection with, ope,n into, use,
alter, or disturb any sanitary sewer without
first obtaining a written permit from the city to
do so.

3, 1980, payment may be made for
system extensions. Nothing herein
shall prevent the accumulation of funds
for operation, maintenance, or exten-
sions if appropriate, in order to fund
such activities which may require gre-
ater resources than may be accumulated
from revenues in said fund for such
purposes, in any one year.
(b) Payment thereafter of the
principal and interest on the Sewage
Collection and Treatment Facilitics
Bonds issued by the city pursuant to
authority therefore given by the elec-
tors of the city at the election held on
February 7, 1961.(c) [t is declared to be the
purpose and intent of this section that
the sewer charges called for in sections
4.002 to 4.094 shall be used and dis-
bursed periodically as necessary for the
purposes set forth herein and no other.
4.224 Sewer Charges-Liabilities. The lia-
bility of any person for unpaid sewer
fees charged to him under code or ordinance
provisions of the city that have subsequently
been repealed shall not be affected by the
repeal of the provisions, nor shall the irrevo-
cable pledge of net revenues for the previously
issued sewage disposal plant and trunk sewer
bonds be affected by the repeal. The liability
shall continue as if the provisions had not been
repealed.
SEPTIC TANKS AND PRIVIES
Springfield Code
4.300 Sewer Connections. Except as section
4.308 provides to the contrary, no
building permit shall be issued by thc city
after the effective date of this code unless the
plans and specifications for such building, in
the event that sewerage facilities are provided
in it, provide that the same be connected to the
public sewerage system of the city as required
by section 3.350 of this code.
4.302 Septic Tanks-New. Except as section
4.308 provides to the contrary, it shall
be unlawful to install a septic tank or other
private sewage disposal'system within the city
after the effective date of this code.
4.304 Septic Tanks-Existing. Exccpt as
sections 4.306 to 4.308 provide to the
contrary:
(1) Where a public sanitary sewer is
not available for a building and the sewer
outlet for the building is connected to a septic
tank at the time this code takes effect, the
connection may be maintained and the septic
tank may continue to serye the buildingl and
(2) Nothing in this article shall apply to
septic tanks or private sewage disposal systems
in use at the time this code takes effect, except
that the surme may not be replaced, and if the
need therefor arisis, then theieplacement shall
be by connection to the public sewerage sys-
tem of the city.
4.306 Privies. Except as section 4.308 pro-
vides to the c6ntrary, no person shall
use or allow on premises under his control any
prily other than a temporary onc that is ncccs-
iaryfor a consEnrction project and is conshrct-
ed'and maintained in'accordance with stan'
dards of the Departrnent of Environmental
Quality.

Composting Toilet Rules

Construction and Installation of Composting Toilets
(1) Defrnition: "Compost toilet" means a permanent toilet receptacle used to receive and
store human wastes, toilet paper, biodegradable domestic garbage, and other vegetative
matter for the purpose of aerobic decomposition of materials received therein.
(2) Product and Design Approval:
(a) Before a manufactured or individually designed compost toilet is installed, approval
must be obtained from the division with concurrence of the boardby an approved
certifier to the approved standards in OAR 918-770-0050 to 918-770-0320;
(b) Criteria used to evaluate the units includes, but is not limited to:
(A) NSF Standard 41 (May 1983 revised); or
@) Composting toilets listed byNSF Intemational to NSF Standard 41 (May 1983
revised) are approved.
(3) Site Locations: Residential compost toilet installations shall be limited to areas where
a grey water disposal system approved by the Department of Environmental Quality can
be installed and used; or such grey water is discharged into a public sewage system.
(4) Installation:
(a) Prior to commencement of the installation of a composting toilet, a plumbing permit
must be obtained from the authority having jurisdiction. A permit will be granted upon
showing:
(A) The site location is in accordance with these rules; and
(B) The manufactured composting toilet or individual design has been approved by the
division or listed with NSF International to Standard 4l (May 1983 revised).
(b) Compost toilets shall be designed to provide a solid connection to the floor with
corrosive-resi stant fasteners :
(A) All suspended under-floor components shall be supported with non-corrosive hangers
adequately designed to support the weight of the system. Hangers shall meet the approval
of the authority having jurisdiction;
(B) All under-floor components designed to set on a stable surface shall have footings
adequately designed to support the weight of the system.
(c) Vent pipes shall be sealed at all joints and insulated in a way to minimize
condensation. The vent stack shall be insulated in a way to minimize condensation. The
vent stack shall extend from each chamber or seat box to a point at least two feet above
the highest elevation of any portion of the building within ten feet of the vent. Each vent
shall be flashed and shall terminate not less than ten feet from or at least three feet above
any window, door, opening, air intake, or vent shaft; nor less than three feet in every
direction from any lot line, alleys and streets excepted;
(d) All compost toilets shall be installed in an insulated area, or the chamber shall be
insulated to maintain a proper temperature inside the chamber to keep a biological
balance of the materials therein;
(e) Where a compost toilet is installed in an existing dwelling, piping, fixhres or
equipment shall be located to not interfere with normal use or normal operation and use
of windows, doors, or other required facilities.
(5) Inspections:
(a) A11 installations shall be installed in a workmanship like manner and shall not be put
into use until inspected and approved by the authority having jurisdiction;
(b) Either the authority having jurisdiction or the division may conduct periodic
inspections of any compost toilet in accordance with ORS 447.124.
(6) Maintenance:
(a) Humus from composting toilets may be used around ornamental shrubs, flowers,
trees, or fruit trees and shall be buried under at least twelve inches of soil cover. Deposit
of humus from any compost toilet around any edible vegetable or vegetation shall be
prohibited;
(b) The compost toilet system of any premises under the jurisdiction of the authority
having jurisdiction shall be maintained in a sanitary and safe operation condition by the
owner or by his agent. Whenever compliance with all of the provisions of these rules fails
to eliminate or alleviate a nuisance or any dangerous or insanitary condition which may
involve health hazards or safety hazards, the owner or the owner's agent shall install such
additional plumbing and drainage facilities or shall make such repairs or alterations or
removals as may be ordered by the authority having jwisdiction.
