parking area at 1840 North 5th Street in comp'liance with an approved
Final Site Plan.
WHEREAS, ih consideration for Site Plan approval, the issuance of a
Building Permit, and the issuance of an 0ccupancy Permit, as specified in the
Springfie'ld Development Code Section 31.090, Applicant agrees to comply with
a'll the standards of the Springfield Deve'lopment Code and Springfield Municipal
Code which may be applicable to this development project, including but not
1 imi ted to, the fol'lowi ng:
No Site Plan conditions are required beyond those found in Artic'le 3L
of the Springfie'ld Development Code.
WHEREAS, in consideration for Site Plan approva'|, the issuance of a
Bui'lding Permit, and the issuance of an 0ccupancy Permft, as specified in the
Springfield Deve'lopment Code Section 31.090, Applicant agrees to comply with
the following specific conditions imposed by the City as part of the Site Plan
approval :
(1) The applicant agrees to submit a bond or cashiers check for 110per cent of the cost of all improvements if Final 0ccupancy is
requested prior to the completion of al'l required improvements.
Fina'l Occupancy must be requested within 180 days of issuance of
bui I di ng permi ts .

EXPRESSLY MADE A PART OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS

AGREEMENT
1. FINAL SITE PLAN. The applicant agrees to submit a Fina'l Site
Plan in accordance with Section 31.080 of the Springfield Development Code
concurrent'ly with this Agreement.
2. STANDARDS. The appl icant agrees to fu'lfi I I a'|1 appl icabl e
standards specified in the Springfie'ld Development Code and the specific
standards 'listed in RECITALS prior to occupancy, un'less certain standards
have been deferred to a 'later date in accordance with Sectfon 31.110 of
the Springfield Development Code.t

3. C0NDITIONS. The Applicant agrees to fulfi'll all specific conditfonsof approval required by the City'listed in RECITALS prior to occupancy, unlesscertain conditions have been deferred to a later date in accordance with
Section 31.110 of the Springfield Deve'lopment Code.
4. MODIFICATI0NS. The applicant agrees not to modify the approved Fina1Site Plan without first notifying the City. Modifications to the Final Site
P'lan shall be reviewed in accordance with Section 31.100 of the Springfield
Development Code.
5. MAINTAINI NG THE USE. The app'l i cant agrees to the fo'l 1 owi ng:
(a) The building and site shall be maintained in accordance with the
provisions of the Springfield Development Code in order to continue the use.
(b) It shall be the continuing obligation of the property owner to
maintain the planting required by Section 31.140 of the Springfield Deve'lopment
Code in an attractive manner free of weeds and other invading vegetation. Inaddition, plantings in the vision clearance area shall be trinrned to meet the 2L/2 foot height standard in accordance with Section 32.070 of the Springfield
Devel opment Code.
(c) Parking lots shall be maintained by the property owner or tenantin a condition free of litter or dust, and deteriorated pavement conditionsshall be improved to maintain conformance with these standards.
( d ) Undeve'l oped 'l and wi thi n the deve'l opment area shal I be mai ntai nedfree of trash and stored materi al s i n a mowed and attracti ve manner.
Undeveloped land shall not be used for parking.
6. In addition to a'll other remedies which may be provided by law orequity (inc1uding but not'limited to penalties provided by app'licable state'lawor ci ty ordi nances ) Appl f cant agrees that Ci ty may enforce Appl i cant' sresponsibilftfes by withholding or terminating App'licant's Occupancy Permit.
7. Any approved Final Site Plan becomes nu'l'l and void if construction
does not commence withfn 180 days of the date of this Agreement.

WHEREAS, itt consideration for Site P]an approval, the issuance of a
Building Permit, and the issuance of an Occupancy Permit, as specified in the
Springfield Development Code Section 31.090, Applicant agrees to comp'ly with
all the standards of the Springfield Development Code and Springfield Municipal
Code which may be applicable to this development project, including but not
limited to, the following:
No Site Plan conditions are required beyond those found in Article 31of the Springfield Development Code.
WHEREAS, ill consideration for Site P'lan approval, the issuance of a
Building Permit, and the issuance of an 0ccupancy Permit, as specified in the
Springfield Development Code Section 31.090, Applicant agrees to comply withthe following specific conditions imposed by the City as part of the Site Plan
approval:
(1) The applicant agrees to submit a bond or cashiers check for 110per cent of the cost of all improvements if Ffnal 0ccupancy is
requested prior to the completion of al'l required improvements.
Final Occupancy must be requested within 180 days of issuance of
building permits.
NOlr'l THEREF0RE IN CONSiDERATI0N 0F THE F0REG0ING RECITALS I'IHICH ARE
EXPRESSLY MADE A PART OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS
FOLLOWS:
AGREET'IENT
1. FINAL SITE PLAN. The applicant agrees to submit a Final Site
Plan in accordance with Section 3L.080 of the Springfield Development Code
concurrently with this Agreement.
2. STANDARDS. The applicant agrees to fu'lfill all app'licable
standards specified in the Springfie1d Development Code and the specific
standards listed in RECITALS prior to occupancy, unless certain standards
have been deferred to a 'later date in accordance with Section 31..110 of
the Springfield Development Code.

4. MODIFICATI0NS. The app'licant agrees not to modffy the approved FinalSite P'lan without first notifying the City. Modifications to the Final SitePlan shal'l be reviewed in accordance with Section 31.100 of the Springfield
Development Code.
5. MAINTAINING THE USE. The applicant agrees to the following:
(a) The bui'lding and site shall be maintained in accordance with theprovisions of the Springfield Development Code in order to continue the use.
(b) It shall be the continuing obligation of the property owner tomaintain the p]anting required by Section 31.140 of the Springfield Dbvelopment
Code in an attractive manner free of weeds and other invading vegetation. Inaddition, plantings in the vision clearance area shall be trinrned to meet the 2t/2 foot height standard in accordance wfth Section 32.070 of the Springfield
Devel opment Code.
(c) Parking 'lots sha'l'l be maintained by the property owner or tenantin a condition free of Iitter or dust, and deteriorated pavement conditions

e.#(d) Undeveloped land withfn the development area shall be maintainedfree of trash and stored material s in a mowed and attractive manner.

6. In addition to all other remedies which may be provided by law orequity (including but not limited to penalties provided by apbticable siate lawor ci ty ordi nances ) App'l i cant agrees that Ci ty may eniorce Appl i cant' sresponsibilities by withholding or terminating Applicant's Occupancy hbrmit.
7 . Any approved Fi na] Si te Pl an becomes nul] and voi d i f constructi ondoes not commence within 180 days of the date of thfs Agreement.

Dear Mr. McGinnis:
The Springfield Building Safety Division recently conducted an Occupancy Inspection
at the above referenced address. The structure ls presently being used as an insurance
office which is categorLzed as a B-2 Occupancy. The building is of Type V-N, wood
frame construction.
In the interest of building safety, the followlng items were noted which do not meet
the minimum requirements of the Building Safety Codes administered by this office:
STRUCTURAL SPECIAL TY CODE AND FIRE AND LIFE SAFETY CODE (S.S.C.)
Because of its close proximlty to the west property liner the west wall of the
garage which has been converted to an office, must be of one-hour fire rated con-
struction. Thts can be accomplished by removi-ng the existing exterior sl-ding and
installlng one layer of 5/8" type x gypsum sheathing, applied with galvar.ized roofing
nails I 314" in length and nailed 7" o.c. in the field and 4" o.c. along the perimeter.
After inspection approval, exterior wood siding may then be installed over the
sheathing to provide the necessary weather protection.

Because of inadequate ceiling height and improper stalrhray constructlon, the second

The patio doors were installed in wall openings without providing for adequate
support of the imposed roof loads. Ileaders are to be lnsta11ed above these openings.

To prevent the potential hazard of fire, electrical wa1l outlets and switch boxes

Grounding type receptacles shall be used for replacement in grounded circuits on1y.
Where grounding means do not exist in a receptacle enclosure, a non-grounding recep-

The temporary wiring (extension cord) serving the light fixtures in the oId garage
area must be replaced with a permanent wiring system.
Landings must be provided for the patio doors not less than

without an insulation covering. The neutral wires are to be identified by the color
white.
A11 necessary permits shall be obtained from this office and the required inspections
approved before a Certificate of Occupancy will be issued.
The above requirements are for the building only and do not include those conditions
established by the Development Review Board, such as parking and additional site im-
provements. Please review the attached material to include in your slte plan submittal.
Again, as we discussed at the site, the Occupancy Inspection and Development Review
requirements are contingent upon the request for zone change approval. If the zone

If the zone change ls approved the Development Coordinatlon Revlew Board will establish
conditions for the coromercial property such as parking, street, sidewalk and parklng
Lot lnprovements, etc. Again, the Occupancy Inspection and Development requirements
are contingent upon the zone change approval. If the zone change is approved, you
must follow through with all of the above stated requirements in order to conply with
City Codes and Ordinances. If the zone change is denied the business must terminateat this locatlon by 30 days after the Planning Commissions decision. The use of the
ProPerty and structure must revert to residentially permitted uses. If you choose
not to apply for a zone change by the May 10th deadline, commerclal use of the property

As you requested, I have reviered all the records we have concerni.ngthe use of property at 1840 North 5th Street as an insurance office.
Before I begin, horrever, I should point out that this property is zonedRL Residential tow Densitlz District. This zoning classification wouldallow an insurance office, but only if the use conplied with the
requirements of our home rccupation ordinance.
The odlnssey @an in May of 1982 when the owner of the property, oneChristos Zafiratos, permitted Mr. Thomas F. McGinnis to request an
occupancy inspection of the subject property. The purpose of Mr.
McGinnisr request was to determine what, if any, structural alterations
would be required to "turn this home into an insurance office for a
snall agency." See attached occupancy inspection application form.
Upon receipt of this request the Building Oivision dispatched severalbuilding inspectors to 5:erform said inspection. The result of this
inspection is attached to this reno in the form of a letter to Mr.
McGinnis from Marion Johnson, building inspector, dated lfiay 25, L982.
You will note that, aside from a rather long list of structural
modifications necessary to allow a conmercial use in a residentialstructure, Mr. Johnson does say, "Other iterns.such as parking, street
improvernents, siderralks, etc., have not been addressed as part of thisinitial inspection and might be reguired as part of the Site Plan
Review if ttre request for a change of zoning is approved." While this
reference to ttre need for a zone change is nrore oblique than we wouldlike, I think most people would conclude that a zone change would be
required before this use could occupy this building.
The City of Springfield has received no further contact from either Mr.
McGinnis or Mr. Zaflratos concerning the letter from Mr. Johnson. No
request for an inspection of work completed was ever sutmitted to the
Building Division. No request for a zone change was ever suLmitted to
the Planning Oetrnrtment. I can only speculate on the likelihood of thestructural mcdificationsr listed in Mr. Johnson's letter, being
ccrnpleted. I do not have to speculate on the likelihood of this
structure being used as an insurance office.
The situation can be concluded in one of four ways:
1. Do nothing, allow the busj.ness to continue as is.
Require a zone change.
3. Allow the use to exist tion. This wouldrequirethe home occr:pation section ofthe Z
Discontinue the use through legal action.

proposed use of the structure as a small connnercial office will categorize that
usage as a B-2 0ccupancy. Our investigation revealed the house is 6'from the
north property line and the garage abutts the rear property line.
The Springfield Zoning Code requires a cornmercial building to be setback 10'
from the side and rear property lines when abutting residentially zoned property.
Therefore, you will have to make application to the Board of Appeals for a variance
to the setback requirements.
Table 5-A of the 0regon State Structural Specilaty Code and Fire and Life Safety
Code (S.S.C.) requires that exterior walls located closer than twenty feet_from
property lines shall be of one hour construction and openings within a wall lo-
cated closer than ten feet shall be protected. Section 502 of the S.S.C. states:
"No change shall be made in the character of occupancies or use of anlt_bui'lding
which would place the building in a different division unless such building is_
made to compiy with the requirements of this code for such division or group of
0ccupancy.
EXCEPTION:The character of the occupancy of existing buildings may be changed
the approval of the Bui'lding Ofticial, and the-building may be occupig{
rposes in other groups without conforming to aI1 the requirements of this
hose groups, provided the new or proposed use is less hazardous, based on
ire risk, than the existing use."

Relative to the above section of the code, the pertinent quest'ion is: Is an office
building a more hazardous occupancy use than a residenge w!th regard !o__!hq required
setbacki and/or fire protectioh? The code allows the Iocal Building 0ffic'iai to de-
c'ide this based on individual circumstances and conditions.
The Bui'lding Official and the Board of Appeals have ruled in the past that buildings
of sim'ilar use, that were near 10' from the property could be releaved of the required
fire protection. Ten feet of the rear of the garage will have to be removed or the
