On May 4,2006, a letter was mailed to the previous owner of this property requiring either the structure be repaired or demolished within a specific time frame (I am enclosing a copy the letter for your reference). A demolition permit was obtained by the previous owner on June 23,2006, but is no longer valid for the work to be completed. In order to achieve compliance with the notice and order, a time frame will now need to be established with you in order to ensure the structure is either repaired or demolished in an expedient manner. Although removal of some debris and garbage has taken place, the structure and property is still unsafe and needs to be addressed as soon as possible. Please notify us prior to Decemb er 12,2006 so we can work together to issue a new permit and establish a completion date for the structure. Lane County Assessment and Taxation records indicate you are the owner of this property. Section 203 of the Administrative Code describes buildings, which are substandard or unsafe as those, which are structurally inadequate, have inadequate egress, or which constitute a potential firehazard or are otherwise dangerous to human life. The following items include, but are not limited to, conditions existing at the structure classifying it as a substandard building: 1. The structural members of the structure have been severely weakened to the point of collapse due to fire damage. If you choose to repair the structure, it must be repaired to meet Oregon One and Two Family Dwelling Code requirements. 2. Due to the fire, the structure is open and accessible and has created an attractive nuisance. No person in charge of property shall permit an open, vacant structure which is attractive, dangerous and accessible to children or which is used for habitation by trespassers. The strrictur:e rnust be secured to prevent access. 3. Damaged roof coverings and broken windows allow for weather infiltration. Every structure shall be weather protected so as to protect structural components from deterioration. 4. Section 5.002 (1X4X10) of the Springfield City Code. Improper Storage and removal of dead organic matter and debris. Used materials. Stored, damaged and/or inoperable vehicles. Lack of adequate garbage and rubbish storage and removal. Because the improper storage and disposition of waste creates a potentially serious public health hazard, dead organic matter and debris must be stored in covered leak proof containers and be removed a minimum of once every seven (7) days. It is unlawful to park, store, leave or permit the parking or storage George Daniel Lee ll22 5th Street Fire Damage May 4,2006 Page2 of any licensed or unlicensed motor vehicle which is in a rusted, wrecked, partially dismantled, inoperable or abandoned condition, whether attended or not, or any destruction derby vehicles or race cars or any kind, upon any public or private property within the city, unless completely enclosed within a legally permitted building that is wholly or entirely enclosed except for doors for use for ingress or egress. Nothing herein shall prohibit the storage of one (1) vehicle not in violation of other provisions of this code, where the same is screened from public view within a legally permitted building or behind a six foot (6') solid fence. Nothing herein shall prohibit the parking or storing or a licensed, operable legally parked, recreational vehicle. Section 202 of the Springfield Housing Code requires that structures classified as substandard must either be repaired or demolished. Therefore, this is your notice that you must secure permits to either rebuild/repair the structure where it is deficient or demolish it. Section 104 of the Springfield Building Codes Administrative Code requires that the repairs must comply with the provisions of the Structural, Plumbing, Mechanical and Electrical Specialty Codes. If the building is to be rebuilt or repaired, permits must be purchased and work must commence within 30 days from the date of service of this notice and order. If the building is to be demolished, demolition work must commence within 30 days, and must be completed within 60 days from the date of this notice and order. Completion means that the structure and the property must be inspected and approved by the appropriate representatives of the Building Safety Division. The sewer must be capped at the property line or the septic tank must be pumped and filled by a person holding a sewage disposal service license as provided fir in Chapter 340, Division 7 of the Oregon Administrative Rules. If you do not seek corrective action within the time frame outlined above, the City may seek compliance with the Building Safety Codes through legal recourse, which may include Municipal Court Proceedings or the City may proceed to eliminatethehazard and charge the costs thereof against the property or its owners. Any person having any record title or legal interest in the building may appeal from this notice and order to the Building Board of Appeals, provided that the appeal is made in writing and filed with the City Building Official within 30 days from the date of service of this notice and order. Failure to appeal will constitute a waiver of all rights to an administrative hearing and determination in this manner. Mr. George is currently in custody at the Lane County Adult Corrections facility and is scheduled for release no later than June 16, 2006. Mr. George is sensitive to the city's needs to proceed in this matter. The items listed in the letter still exist, and the debris is continuing to accumulate. As of today, May 26,2006, the deadline is still applicable and if the building is to be demolished, demolition work must commence within 30 days from the date of the letter (June 4,2006) and must be completed within 60 days from the date of the letter (July 5, 2006). If the building is to be rebuilt or repaired, permits must be purchased and work must commence within 30 days from the date of service of the original notice and order (June 5,2006). Lane County Assessment and Taxation records and a recent title search reveal that you. are the owner of this property. 1. Section 203 of the Springfield Building Safety Code Administrative Code classifies structures which are structurally inadequate or dangerous to human life as unsafe. Section 1001 of the Springfield Housing Code specifies conditions constituting substandard buildings. The following conditions include but are not limited to conditions existing at the structures identified above, classifying them as substandard and unsafe buildings. 2. The property is not currently served with water service. The Housing Code requires that each residence shall be provided with hot and cold running water. 3. The property is not currently served with electrical service. The Housing Code requires that each residence shall be provided with heating facilities capable of maintaining a room temperature of 68 degrees F. at a point 3 feet above the floor in all habitable rooms. The Code further states that where there is electrical power available within 300 feet of the premises of the building, such building shall be connected to such electrical power. 4. Each dwelling shall be provided with a water closet, lavatory, and a bathtub or shower. It was evident during our inspection, an accessory structure in the back yard had been constructed without the required permits an&or inspections. This structure must be demolished or required drawings for the structure must be submitted to this office for approval. Following approval of the drawings, required permits must be obtained, required inspections requested, performed, and approved for this structure. 6. At the time of my inspection, numerous electrical code violations were observed. A complete electrical inspection of the structure will be required prior to the electrical service being reconnected. Section 204 (b) of the Administrative Code provides procedures where the Building Official may require vacation of the premises when cited deficiencies represent an immediate hazard to life, limb, property or safety of the public or its occupants. Notice is hereby served that the property being posted is to remain vacant due to the potential hazards to the occupants resulting from the above cited conditions. If you or your tenants re-occupy the premise prior to written approval by the Building Official, the City will seek compliance with the Building Safety Codes through legal recourse, which may include Municipal Court proceedings.
