II . APPROVAL ACTION Approval of the requested variance, based on the findings listed be1ow. III. GENERAL INFORMATION A. Location and Site Description: The subject property has an address of L375 South 2nd Street, Springfield. It is occupied by a residence and an accessory structure. B. Surrounding Area and Zoning The surrounding parcels are zoned RA/U District and are developed with residences. C. Services Fire: Temporary service only from City of Springfield Water: Springfield Utility Board Sewage: On-site subsurface disposal Access: South 2nd Street; a County Road D. Referral Responses Transportati-on Planning: Facility permit required for modificati-on of exi-sting or construction of a new driveway. Springfield Planning Department: Springfield's code does not limit location of accessory structures. No objection to granting variance. IV. APPROVAL CRITERIA AND FINDINGS 1 2 A. Plan Conformity Comprehensive Plan Designation: Low Density Residential Area General P1an. Metro 2. Applicable Policies - None B. Lane Code, Chapter 10.330-20 Approval of a variance requires complj-ance with the criteria listed in LC 10.330-20. The criteria and findings are presented in Section V below. V. FINDINGS Thot there ore exceptional or extroordtnwy ctrcumstances or conditions applicable to the property inrtolyed or to the intended use of the property whtch do not apply generolly to other properties in the same zoning dtstrict. Development on the subject property, which includes a residence, shed, and subsurface sewage disposal system, occupies the rear half of the 1ot. It is impossible to place the building in the rear half of the lot and sti11 maintain adequate separation between structures and sewage system. Residences are normally placed in the front half of lots thereby allowing accessory buildings in the rear. Tlut the granting of the yariance will not be detrimental to the public heolth, safety or welfare or materially injurious to properties or improvements in the neor vicinity. Adequate distance can be maintained between the proposed structure and surrounding buildings so that danger of fire is minimized. The building is proposed to be setback 50 feet from the front property line. An adequate distance to avoid the appearance of crowding of structures on the property. VI. FINAL COMMENTS A. Summary It appears impractical to require the proposed accessory structure to be located in the rear half of the lot since that area is already occupied by a residence and other accessory uses. The proposed building will be setback from South 2nd an adequate distance so as not to appear crowded. B.
