SUBJECT: PROPOSED ASSUMPTION OF DEVELOPMENT PERMIT FEES FOR NEDCO
ISSUE
At its March 8, 1991 meeting, the City Counc'i1 agreed to temporarily assumethe cost of development permit fees for the Neighborhood Ecohomic DivelopmentCorporation (NEDC0) Iease-to-own house at 1133 fiater Street. The Councjirequested feedback on whether Communjty Development BIock Grant (CDBG) fundscould be used to pay-the development perm'it fees. Is this a legil anil proper
use of CDBG funds? Council also requested staff to develop crileria to'be'used in determining when the City would assume permit costi for low-incomehousing projects, where funds might be approprihted, and at what level.
BACKGROUND
John Hubb'ird, Executive Director_of NEDCO, submitted a letter to the Mayor andCouncil requesting that the development permit fees assocjated with devilop-ment of a:l!91e-famjly residential lot at ll33 Water Street be assumed by'Council. Although Mr. Hubbird's letter discussed an estimated fee amount of
$91ar the estjmated total did not jnclude aIl permit costs associated wjth theNEDCO-development.proposal. As calculated by the guilding Divjsjon staff,actual estjmated development fees that the Council mjght issume for theproject include:

DISCUSSION
In a City Attorney opinion, dated August 28, 1990, the attorney stated that
"any council action ... where fees were simply waived 0n a case by case basis
without criteria" r'lould not "withstand judicial scrutiny". The opinion
further states that "any ordinance, even with criteria, will be open to
serious question and probable 'l itigatj0n. . . ".
Council has recommended developing crjteria and a funding mechanjsm for
addressjng requests for assumjng permit fees. At the Council meeting, Mr.
Hubbird stated that NEDC0 would pay the development perm'it fees if this
proposal did not meet developed crjteria. After consulting with the Housing
and Urban Development (HUD) Department, staff concludes that the above costs
are not eligible for CDBG funding because CDBG funds cannot be used to
reimburse the Cjty for expenses it would otherwise incur. The only other
option for funding is the General Fund.
RECOMMENDATION
The $1,190.74 permit costs for the NEDC0 proposal wi'I1 be assumed by theCity's General Fund. The permits will be issued with the qualificat'ion thatthe applicant must reimburse the City should this project not meet criteria
which is to be developed over the next ninety days or so.
