Dear Pastor Snare:
This letter is written to confirm recent discussions involving you, Jeff Bure11,
and myself regarding the requ'irement to pave the Thurston Christian Church parking
I ot.
0n January 4, 1984 the Planning Commission denied the request of Thurston Christian
Church for a variance to the parking 1ot paving requirement spec'ified in the C'ity's
Comprehensive Zoning Code. At the same time, the Plann'ing Comm'ission directedstaff to work with representatives of the Church to assure that the parking 1otis paved withjn a reasonable period of time. To this end, we have recommended
the following: the Church will establish a "parking 1ot construction account"
at a local financial institution; the City - either myself or the Finance Director -will be notified by the financial jnstitution of all transactions associated with
this account; a substantial portion of the parking lot paving wi1'l be accomplished
by November 15, 1984.
If final agreement on the above'items - or some equally acceptable alternatives -
can be reached by June 30, 1984, the City will issue a Temporary Certificate of
Occupancy covering all areas of the new construction. If an acceptable agreement
cannot be reached by June 30, 1984, or if a substantial portion of the parking 1otis not paved by November 15, 1984, all portions of the building for which permits
have been issued since Ju'ly 10, 1978 will be ordered vacated. The areas vacatedwill then remain vacated until the entire parking lot is paved.

Subject: Paving of Church Parking Lot
Dear Mr. Randall:
As a result of the Planning Commission decision of
January 4, 1984 to deny your variance request relativeto the Church's unpaved parking 1ot, and the furtherdirective from the Commission requiring City staff tonegotiate with the Church to establi-sh a procedure to
assure that the parking lot is paved within a reason-able time period, City staff members will be meetingthis week to discuss the issue. It is our intent to
"brainstorm" the subject so that all possible solutions
can be considered and guidelines establi-shed.
I suggest that the Church officers also meet within the
next week to decide what commitment can be made;to as-
sure that paving of the parking 1ot occurs.
I vri11 be contacting you next week to arrange a meeting
between appropriate Church members and Citg staff.
Please be prepared to discuss a proposal which willassure the long overdue paving commitment is resolved.

story classroonr addition and paved parking. Condition K staLed: rrAlL
new parking must be paved and drained to the City storm sewer system
(at this tirne it was thought that, the Thurston Road improvenrent project
which included drainage facilities, and was to be initiated Lhat
sumrner, would include the Chur chIs street frontage; however, Lhe
projecl went only to llorth 66th Street and there was no drainage
facility for Lhe Church to connect to). See exhibits 1 and 2.

5-16-79 - The Ci.Ly granted the Clrurch permission to occupy porLions of
the new adciition provided Lhe parking lot and drainage requirernents
were compleLed by 10-1-79. The letteir also staLed: rr...the City may
clioose to exercise another option. ThaL is, in lieu of causing the
parking 1ot pavlng and drainage to be completed, ttre City rnay choose to
wittrdraw the ternporary occupancy permit and order the vaeation of all

Blackstone, C[airman of Lhe Springfield Planning Cornmission, asking for
a permanen! occupancy permit stating that all stipulations of the
8-26-82 and 8-30-82 leLters have been rneL except for paving Lhe parking
Iot. See exhibit 9.

Variance Reque st F'indings
SecLioti 17.04 of tLre Springfield Zonlng Code states: rrA variance is a
perrrrission granted as relief from some speeific and unusual hardship(s)
irnposed by the strict interpretation of this ordinance.rt I'Before the
Planning Commission or Building Board of Appeals grants a variance, the
following criteria shaIl be considered:
1. TtiaL there was exceptional or exLraordinary circumstances or conditions
applicable to Lire property or intended use that do not apply generally
to other-property or class of use in the sarne viciniLy and zone;tt
As was stated earlier the Church was a pre-existing use upon
annexation. When the Church applj.ed to the City f'or its addiLion' the
greatest portion of ttre required paved parking area was necessary to
rneet Lhe neecis of Lhe Church itself rather Lhan the classroon: addition.
Sinrilar land use requests are required to nrake physical imrnproven'rents
as a precondition of approval. While the proposed Thurston Road
improvenrenL project did not include the Churcirrs frontage along Lhat
road, the City later reviewed and approved plans prepared by the Church
for a parking facility vrhich nret City requirements rel,ating to
drainage.
ttz. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same
viciniLy and zone, but which is denied Lo the property or.rner in
question or is necessary Lo establislrmenL of a use essential for
necessary service to the public;rr
A Church in a residenLial area has typically required a CUP (now SUP)
an<l conditions imposecl have always included paved parking. The
surrounding residential uses have paved their required off sLreet
parking (i.e. driveways). And, ihough the services Lhe Church provides
are beneficial, they do not qualify as an essential or necessary
service Lo Lhe public. Police, Fire and utiliLies qualify as essential
public services.

abutting property and the character of the neighborhood in the
following respects: fub1ic safety, traf'f ic, noise, health and
sanitation and hours of operation; rr
The two most signj.ficant negative effects of ttie proposed use would be
ttre inLroduction of particulate matter into the airshed and tracking of
rock and dirL onLo the public righb-of-vray. V,hiIe these occurences are
not specifically inconrpaLible with tlre daily events of abuLting
properties, they do influence Lhe overall appearance of tlre
ne ighborltood.
rrl]. That the granting of such variance will not adversely affect the
I'ietropolitan /irea General Plan or Lhis Ordinance.rl
It is Lhe contention of the Lane Begional Air Pollution Autliority Lhat
the dust that results from unpaved roads and parking areas is the
single largest contributor to the suspension of large particulaLe
matter in Eugene-Springfield air. The l4etro PIan has the following
comrnents on air quality:
ttThe high value placeci on clean air and water by 1oea1 residents is
reflected in local commitments Lo plans and programs directed toward
reducing air and water pollubi.on.
The potential for air pollution in Lhe Upper I'Jillamette Valley is
considerab1e due Lo prevailing winds, to surrounding mountains which
trap the air, and the natural conditions caused by temperature
inversions.
The metropolitan area violates State and Federal air qualiLy sLandards
for suspended parti.culates (solid and 1lquid particles of soot, dust'
aerosols and fumes). Carborr, llonoxide (a colorlessr orderless boxic gas
mostly resulting from incomplete combustion from automobile engines),
and State standards for ozone (orderless, toxic gasses produced by
reaction between oxides of nitrogen and hydrocarbons in the presence of
sunlight). Suspended particulates represent the most severe air

Di scussion
There are a number of points to be rnade here:
In the history of this project, the Chureh has always found money to
work on or complete ttie structure, rather than the parking facility.

A1so, wlrile the Site Plan Review Board required drainage to be tied in
to a street project rrhich eventually did not include the Churchrs
property, the Church itself has developed plans which have been
approved by tlre Clty for both dralnage and paving. The Church has
shown a willingness to cooperate wiLh Lhe City, but the track record
shows that the Church has placed paving the parking area on a 1ow
pr ioriLy
Section 16.07 (A) of the Springfield Zoning Code does not allow much
flexibility in cases like this. But in November' bhe Planninng
Cor,rmmission considered a similar appeal by the Church of the Brethren.
In that case, ttre Planning Commission was able to tie in paving to
future construction. In this caser consLruction is virtually complete
and final occupancy is being requested. However, staff would consider
the use of a bond or the establishment of an account into which the
Church may make moneLary payments. (Be aware that the paving permit
issueci in 19Bt showec.l the vaLue of the work as $26' 100. )
Finallyi a more general issue is also involved: How long does one have
to appeal a Site PIan (now Development Coordination) Board decision?
The original eonditionrrKn to pave the parking area was deLermined in
I,layi 1978. Typically, in that process, the appJ.icant has 10 days to
appeal any condition by the Board. Can Lhe Church appeal this
condition after 5 1/2 Years?
Becommenciation
Deny the requesL for failure to satisfy variance standards; and
Require the Church to pave the parking area by June 30, 1984' and to
poit a bond guaranteeing paving of ttre'parking area prior to final
occupancy.

SUBJECT: Temporary Occupancy Permit
Dear Mr. Randall:
We are novr inpossessionof your letter dated May 8,1979 regarding
the completion of your building project.
More specifically, Thurston Christian Church has agreed to complete
the parking lot paving and drainage portion of its building project
by 0ctober 1, 1979. In the event that the church is unable to comp-lete same by the specified date, it has been further agreed that the
City may cause said improvements to be made and charge a'l'l costs thereofto the church.
In-lieu-of the above, please be avrare that the City may choose to
exercise another option. That is, in-lfeu-of causing the parkingiot pav'ing and drainage to be completed, the City may choose to rvith-
draw the temporary occupancy permit and order the vacation of allportions of the building associated with the new construction. Said
vacation would then be in effect until the parking 1ot paving and
drainage are completed by the church.

the annual Fire Department inspection of the nerv construction for the Thurston Chris-
tian Church on August 23, 1982.
A temporary occupancy permit rvas granted to the church to occupy portions of the new
building on Irlay 16, 1979 provided the parking lot paving and drainage portion of its
building project were cornpleted by October 1, 1979. An extension of the deadline was
approved and a permit for paving the parking 1ot was issued to the church on llarch 25,
1982. Please accept this as a notice that the perrnit rvi11 expire on Septenrber 25, 1982.
Our records indicate no insoections have been made of the underground piping system from
the catch basins. It will be nece-ssary to have the pioing system inspected before the
lot is paved. The inspection also ::evealed some additional items that must be corrected
to continue the occupancy of the building.
1. The door giving access to the baptistry from the corridor and the door giving
access to the chancel area from the corridor must be a tight-fitting smoke and
draft control door assenrbly having a fj-re-protection rating of not less than
20 ninutes. The door and frame shal1 bear an approved labe1 or other identi-
fication shor^,ing the rating thereof. See attachnient marked Number 1 (doors

Site Descriptfgn
Slte ls the north half of a property orned by Thurston Chrlstian Church
1n East $rlngfleld (lhurston), Oregon. Southeast sectlon of the site
ls occupled by the orlglnel church to nhlch addltions w111 be rnade.
Slte 1s sltuated 1n nld-b1ock, frontlng to the south on I'hurston Road,
and between 66ttr and 69th Streets. Property J-s leveI, developed and
landscaped. Ilest borlng locatlons at the slte arc tndlcated on the at-
tached plot plan (&rclosure No. 1).

Ihree (3 ) e:rploratory borings were sunk at the proJect slte (&rclosure
No. L). Borlng No. 1 was located 1n the approxinate area of the proposed
sanctuarT, neai the future cholr platforn. Borlng No. 2 was located near
the nortir s1de, and approxlmately centered, east-to-rest, ln the proposed
additlon ir€8. Borlng No. 3 was located on a Ilne approxlmately colncldlng
vlth the naln east waU of the exlsting church, and approrimately centered
north-to-south ln the area of the proposed addltlon. A11 borings rere ter-
minated in solls nhlch resulted ln near refusal or refusal to drllllng ef-
fort. Borlng No. 1 was stopped at 1& feet, Borlng No. 2 at 21 feet and
Borlng No. I at 1* feet. A CUE-55 tnrck-mounted drllllng rlg wlth standard
sampling technlques lras used 1n the erpl.oratory uork.

To determlne the relative consistency of the solls, di-fflculty of drll1ing
was noted. Due to the nature of the materlals found (medlun-to-1arge gra-
vels ), blow counts were estlnated for the nrost part sjxce a standara "!fit-spoon sampler couLd not plck up any materials and would only be destroyedin the process. lltrere performed or estlrnated, sampli-ng and penetratlon re-
sistance comply wlth requirenents of ASf,li! D-1585. Penetratlon reslstance,
actual or estLmated, per foot of penetration uas logged and appears to therlght of each graphical- rllog of Borlngs rr lncluded wlth thls reporb (&,"1o-
sure No. 2).
lhterials encountered rere coarse, resultlng in conslderable drlll resistance,
and are judged stable and excellent for footlng placenrent. the church pro-
perty would apPeer to be situated ln an area of anclent rocky rlver bed, de-
qosited by a forner course of the McKenzle ftlver, whlch today flows only one(1) mlLe north of the church.
Visual classlflcatlon was logged for each solI stratum and, again, appears
to the rlght of the graphical rrlog of Boringsrrlncluded hereln. Synbols
and other descriptlons wlLl be found ln the enclosed t'Key to Borlng Iogstt
(Enclosure No. 3).
Itee water levels were qulte deep, slnce the gravels at the slte could be
erpected to be falrly free-dral,ning. tr}ee water wes estimated at a depthof 17 to 18 feet in Borings No.fs 2 and l, and was not observed in Borlng
llo. 1. the Willarrette Va1),ey area of the site ls experienclng a very uet
wlnter thls year, therefore, lre world not expect the water table to be rnrch
higher than observed at thls tlme.
Soil Cl-asslfieatlon
thls slte exhlblts a very shallow area (approxlmately 5") of what could pro-
perly be termed rtopsollrtthroughout, and even thls uas qulte grave1Iy. In
the aree of Borlng No. 1, sna1l amountg of clays were mj,xed with slIty or
sandy GRAVEIS to a depth of 3 to lr feet. these were the only clays observed.
Silty and sandy GRAVELS. up to t'cobbleil glze, were distributed unlformly
throughout the depth of alL of the borings. As nentloned above, the GnA,Vm,S
found uere very stable and solid ln each of the borlngs.
Greatest anticipated footlng loads ln the proposed addition ui11 be in the
sanctuary area (Bortng No. 1 ). The very sma11 amounts of cljyey GRAVELS ln
the area woul-d probably be removed for sonewhat overslze footlngs, therefore,
for the nost part, the presunptive so11 bearlng values at thls site nay be
goverrred by the sllty and sandy GRAVELS. Ground water would not be expected
to pose a maJor probLem at the site.

SUBJECT: Temporary 0ccupancy Permit
Dear Mr. Randall:
We are now inpossessionof your letter dated May 8,1979 regarding
the completion of your building proiect.
More specifically, Thurston Christian Church has agreed to complete
the parking 1ot paving and drainage portion of its building project
by October 1, 1979. In the event that the church is unable to comp-
lete same by the specified date, it has been further agreed that the
City may cause said improvements to be made and charge all costs thereof
to the church.
In-lieu-of the above, please be aware that the City may choose to
exerc'ise another option. That is, in-lieu-of causing the parking
1ot paving and drainage to be comp'leted, the City may choose to with-
draw the temporary occupancy permit and order the vacation of all
portions of the building associated with the new construction. Said
vacation would then be in effect until the parking 1ot paving and
drainage are completed by the church.
In order to avojd any of the complications mentioned above, we sincerely
hope that the church is able to complete the project as planned. In
the meantime, p'lease accept this letter as your temporary permit to
occu-py the newly constructed port'ions of the building until 0ctober
1, r979.
