EXPLANATION OF THE NATURE OF THE APPLICATION
The applicant has submitted an application to the City of Springfield for a Modification of Provisions (a
variance from SDC 16.050(2) which specifies the width of a building setback from an interior property line)
to reduce the required side lprd setback from 5 feet to 4 feet. The intent of this application is to allow the
construction of a carport. The subject property is zoned and designated Low Density Residential (LDR).
LOCATION OF PROPERTY
The subject property is located at 664 Sunset Drive (Assessor's Map# 17-03-34-14, Tax Lot 10200).
DECISION
Approval with no conditions.

WRTTTEN COMMENTS
Type ll land use decisions require the notification of property owners/occupants within 100 feet of
proposed development allowing for a 14 day comment period prior to the statf decision. There were no
written comments submitted.
CRITERIA OF APPROVAL (Ref. SDC Secrion 11.030(1)).
THE DIRECTOR MAY ADJUST ANY QUANTITATIVE STANDARD OF THIS CODE INVOLVING UP TO
A 20 PERCENT REDUCTION OR INCREASE PROVIDED THAT:
(a) LocATIoNAL oR DIMENSIONAL PROBLEMS HAVE BEEN IDENTIFIED; AND
The request is for a reduction of the S-foot side yard setback as specified in SDG 16.050(2). The
applicant states: "The 20 percent reduction of the 5 foot sideyard setback to 4 feet is requested because
of the limiting driveway entrance width to the building site. The drtveway slopes down 4$ feet, in a 24-28
foot hoizontal distance, and then arrtves at an existing concrete slab. The concrete stab is level. lt is
used for parking two cars and the driveway has a 2-fat tlare, at the north side of the drive, to allow
adequate access to the side-by-side parking spaces. The 1 foot reduction in sideyard allows for a safer
and broader opening width at the carport entry and exit."
Finding: A dimensionalproblem has been identified;the S-foot side yard setback as specified in SDC
16.050(2) must be reduced by one foot in order to construct a carport.
(b) THE PROPOSED ADJUSTMENT IS THE MINIMUM4MilOMUM NECESSARY TO
ALLEVIATE THE IDENTIFIED DIMENSI0NAL oR LocATtoNAL pROBLEM; AND
The maximum adjustment allowed underthese provisions is 1 foot (20 percent of the S foot side yard
setback standard under SDCl6.050(2)). One foot is also the minimum adiustment to alleviate thL
identif ied dimensional problem.
Finding: The request for a 1-foot reduction (20 percent) is the maximum adjustment allowed and is the
minimum necessary to alleviate the identified dimensional problem.
(C) THE FOLLOWING ADVERSE AFFECTS ON NEIGHBORING PROPERT//ES WILL NOT
OCCUR AS A RESULT OFTHIS MODIFICATION OF PROVISIONS:
I. CREATES DEMAND FOR ON.STREET PARKNA
There a19 two existing paved off-street parking spaces on the subject property. SDC 16.070(5) requires 2
paved offl9treet parking spaces for each single-family dwelling. No additional parking is proposed; no
parking will be eliminated. The proposed reduction will not create a demand for on-sireei parking.
Finding: The proposed reduction of the 5 foot side yard setback as specified in SDC 16.050(2) wifl have
no impact on on-street parking because there still will be compliance with the otf-street parking
standards.
2. INCREASES
'VO'SE,
ODOR OR DUST;
The existing driveway where the carport is proposed is already paved. There wilt be no change in the
operation of the existing driveway caused by the proposed carport.
Finding: The proposed reduction of the S-foot side yard setback as specified in SDC 16.050(2) wilt have
no impact on noise, dust or odor because the driveway is already paved.

3, CREATES VISION CLEARANCE AREA HAZARD FOR PEDESTRIANS, BICYCLISTS OR MOTOR
DRIVEN VEHICLES;
The proposed carport shown on the plan submitted is approximately 32 feet from the front properg line.
The required vision clearance area as specif ied in SDC 32.070(3) is measured 10 feet along the f ront
property line and 10 feet along the side property lines. The proposed carport is at least 22leel f rom the
vision clearance area, outside of the vision clearance area.
Finding: The proposed reduction of the 5 foot side yard setback as specified in SDC 16.050(2) will have
no impact on vision clearance because the proposed carport is at least 22leelfrom the vision
clearance area.
4. ENCROACHES ON SOLARACCESq
The propefi is zoned and designated LDR. The proposed carport is located near the south property line.
The solar access minimum height standard in the LDR District is 21 as specified in SDC 16.060(1). The
height of the proposed carport is 13 feet, which is below the minimum height standard cited above.
Finding: The proposed reduction of the S-foot side yard setback as specified in SDC 16.050(2) will have
no impact on solar access because the height of the proposed carport is less than 21 feet.
5. CREATES A HAZARDOUS FIRE PROTECTION OR FIRE SUPPRESSION SITUATION.
The proposed carport is an addition to an existing single family home. A hazardous fire protection
problem has been identified. The propefi to the south, 606 Summit, contains a single family home with
the wallof the garage on the common property line with this property, 664 Sunset Drive. The plan
submitted showed, and a site visit has confirmed this situation. The proposed carport requires a building
permit that the applicant has applied for (991M0). During the review of the building permit, building code
fSfafe of Oregon 1996 Edition One and Two Family Dwelling Specialty Codd) issues relating to fire
protection are evaluated. Chapter 3 Building Planning, Subsections 302.1 and 302.2 of the above
cited Code require 6 feet of separation between buildings; 3 feet on each side of a common property line,
unless there is a one-hour rated fire wall. Based upon the plan submitted there will be only 4 feet
between the garage and the proposed carport supports. The applicant has confirmed that there is an
existing one-hour rated firewall on the neighboring property on a drawing submitted to the Development
Services Department on September 24, 1999. There is a fire hydrant further north on the east side of
Sunset Drive that meets the lire suppression portion of this criterion.
Findings:
1. The proposed reduction of the S-foot side yard setback as specified in SDC 16.050(2)
meets the hazardous fire protection situation portion of this criterion because the
applicant submitted information to staff demonstrating that building code regulations
pertaining to building separation are met.
2. The proposed reduction of the S-foot side yard setback as specified in SDC 16.050(2)
meets the fire suppression situation portion of this criterion because there is a fire hydrant
nearby.
(d) PUBLTC SAFETY WILL NOT BE COMPROMTSED.
Public safety refers to ambulance service or police operations; fire protection has been discussed above.
The proposed carport does not impact Sunset Drive or the bottom 22feel of the existing driveway that is
where ambulance service or police operations would access the property.

Finding: The proposed reduction of the 5 foot side yard setback (SDC 16.050(2) will have no affect on
public safety in relation to ambulance service or police operations because it does not impact the
operation of Sunset Drive or the driveway access to the home.
CONCLUSION
The Director has determined this request can satisfy or can be conditioned to satisfy the applicable
criteria of approval listed under SDC Section 1 1 .030(1). There are no conditions of approval because all
criteria of approval have been met.
APPEAL
lf you wish to appealthis Type ll Modification of Provisions decision, you must do so within 10 days of the
date of this letter. Your appeal must be in accordance with Springfield Development Code, Article 15,
APPEALS. Appeals must be submitted on a Cityform and a fee of $250.00 must be paid to the City at
the time of submittal.
