VHEREAS, the applicant has asked the City to authorize the Applicant toimmediately commence development improvements vithout a compllted plan reviev or
subsequent aPproval as required by the Springfield Building Safety CodeAdministrative Code section 303(a)
YHERPAST.'the Applicant has submitted to the City a completed permit appllcation,3 (three) sets of-construetion dravings, specificationi, and other daii requiredfor the City to complete the necessary plan reviev of the proposed development
improvement.
VHEREAS, the intendbd development improvement is of a nature that requires noother reviev approval from other State or local agencies and is exempt from thecriteria established by the Building Safety Division, attached as Exhibit A ofthis $,greement.
UHEREAST the City has not revieved or approved the submitted materials for the
development improvement, the City is therefore unable to confirm at this timevhether the permit applicatic:: submitted vill- be approved, and vhether theqequired cond,tr-ruction permits can be issued.
VHEREAS, the Epplicant has requested th6 City to provide expedited aurhorizationto proceed vith certain phases of construction prior to the completion of theCity's reviev of the permit application.
WH.ERXAST the City's fee for the administrative services rendered in providing
expedited authorization is S150.00.
NOU, THEREF0RE, in consideration of the foregoing recitals and of the mutual
promises eontained herein, the City authorizes immediate commencement of the
development improvement specified in the permit application subject to thefolloving terms and conditions:

2. City agrees to reviev Applieant's. permit application in the normal revievprocess and to thereafter:

must be remedied before permits can be issued; or
c)-advise-Applicant of any statutes, ordinances or code provisions vithvhich Applicant must compry vith before city can issue the permit.
3.- Applicant agrees that if City finds Applicant,s permit application andsubmitted materials_inadequate or deficient in any manner iirttuaing.but notlimited_ tor -the application or the proposed construction do not com[ly vithall applicable statutes, ordlnances or code provisions, Applicant vifiexpeditioulIy^cure the deflclencies so that the City may iisue the requiredpernLts. Should Applicant fail to expeditlously correct- subnitted materials,or should correction prove impossible, City nay in itrs discretion, take anyor all of the .folloving actions:
a) stop aII further construction of the project in the manner prescribed.in the Springfield Building Safety Code Administrative Code (BSCAC),

6. Applicant agrees that all vork performed under this agreement shall beaccessible and exposed for inspection purposes and that neither the BuildingOfficial nor City shalI be liable for the-expense entailed in the removal oireplacement of any material necessary to arliv inspection.
7 - Applicant agrees that any or aII'deficiencies identified during thenecessary inspections vi11 be promptly renedied, at Applicant,s sole cost

B. Applicant agrees that no vork shal1 be done on any part of the buildingor structure beyond the point indicated in each successive inspectionvithout first obtaining the approval of the Building Official.-Such approvalshal1 be given only after an inspection has been made of each successirestep in the construction as indicated on the attached Exhibit B.
9. Notvithstanding any other provisions of this Agreenent, this AgreementshalI terninate upon lssuance of a building pernit or thirty (30)-days fromthe.date of this Agreenent, vhlchever first occurs. Applicant understandsthat all vork on the project shall imnedlately cease vi.thout any notlce fromthe City if this Agreenent terninates before a building pernit is lssued.This agreement shall teruinate on t

11. The terms of this Agreement shall extend to and be binding upon theparties he.reto and tiieir heirs, successors and assigns.
12. If any suit, action or other proceeding, or an appeal therefrom, isinstituted to obtain, establish, enforce, or compel any right or obligationresulting from this Agreement, the prevailing party shall be entitled torecover from the adverse party, in addition to costs and disbursementsr suchadditional sums as the courts, both trial and appellate, may judge
reasonable attorney fees.

Purpose
The purpose of this agreement is to a1lov'certain development improvements tooccur prior to obtaining plan reviev approval from the Springfi.eld CommunityServices Division.
Scope
The use of this agreement shall be limited to certain one and tvo-familydvellings not complex in nature as determined by the Building 0ffieial and
minor alterations or modifications to existing commercial and industrialbuildings vhich are of a non-structural'type and do not adversely affect anystructural member of the building or any part of the building having fireresistant construction.
One and tvo-family dvelling plans for structures that are complex in nature that
have been prepared by an Oregon licensed architect or engineer and accompanied.
by a letter of reviev prepared by said architect or engineer, stating that the
submitted material is in compliance vith the One and Tvo-Family DvellingSpecialty Code, may be considered eligible for this agreement.
The folloving itens include but are not limited to certain conditions of
development identified as ineligible for tiris agreement:
a) development requiring site approval vhich has not been obtained i
b) nev development located on land vith over six-percent slope;
