MADE A PART OF THIS AGREEMENT, CITY AND APPLICANT AGREE AS FOLLOWS:
AGREEMENT
1. FINAL SITE PLAN. The app'licant has submitted a Fina] Site Plan in
accordance with Section 31.080 of the SDringfield Deve]opment Code.
2. STANDARDS. The appl icant agrees to ful fil I al I appl icable standards
specified in the Springfield Deve'lopment Code and the specific standards listed in
RECITALS prior to occupancy, unless certa'in standards have been deferred to a 'later
date'in accordance with Sect'ion 31.110 of the Springfield Development Code.
3. C0NDITI0NS. The Applicant agrees to fulfill all specific conditions of
approval required by the City listed in RECITALS prior to occupancy, un]ess certain
condit'ions have been deferred to a later date in accordance with Section 31.110 of
the Springfield Development Code.
4. M0DIFICATIONS. The applicant agrees not to modify the approved Final Site
Plan without first notifying the City. Modifications to the Final Site P'lan shall be
reviewed in accordance with Section 31.100 of the Springfield Development Code.
5. MAINTAITIING THE USE. The applicant agrees to the following:
(a) The building and site shall be maintained in accordance with the
prov'isions of the Springfield Development Code in order to continue the use.
(b) It shal I be the continuing ob1 igation of the property owner to
maintain the planting required by Section 31.140 of the Springfield Development Code
in an attractive manner free of weeds and other invading vegetation. In addition,
plantings in the vision c'learance area shall be trimmed to meet the 2 l/2 foot height
standard in accordance with Section 32.070 of the Springfield Development Code.
(c) Parking 'lots shall be maintained by the property owner or tenant in a
condition free of litter or dust, and deteriorated pavement conditions shall be
improved to maintain conformance with these standards.
(d) Undeveloped 'land within the development area shall be maintained freeof trash and stored materials in a mowed and attractive manner. Undeveloped land
sha'll not be used for parking.
6. In addition to all other remedies which may be provided by law or equity
( i ncl udi ng but not 'l imi ted to pena'l ties provi ded by appl i cab]e state l aw or ci ty
ordi nances ) Appl i cant agrees that C'i ty may enforce Appl i cant' s responsi bi I i ties by
wi tnnol di ng Appl i cant ' s Fi nal Occupancy Permi t, and termi nati ng any Temporary
0ccupancy Permit which may have been granted.

The existing landscaping can be removed as shown provided the sight
obscuring (slatted chain link) fence is constructed as shown on your plan
(note: the fence can be 6 feet in height without barbed wire or 8 feet, in
height with barbed wire).
The area where the shed is to be constructed will e'liminate the existing
off-street parking spaces. The plan submitted does not show the relocation
of the existing oFf-street parking spaces. Seven off-street parking spaces
are required ior the existing use. The existing off-street parking can be
incorporated in the expansion proposal. Six off-street parking spaces will
be required for the proposed warehouse.
A revised Site P'lan needs to be submitted addressing the.parking issue
above within 90 days of the date of this letter, unless you wish to combine
this modification with the Site P'lan for the proposed warehouse.
