Homeowners acting as their own general contractors to construct a new home
or make a substantial iriprovement to in existing structure, can prevent many problems
by being aware of the following responsibilities:
Homeowners who use labor provided by workers not licensed by the Construction Contractors
Board, may be considered an employer, and the workers who provide the labor may be considered
employees. As an employer, you must comply with the following:
Oregon,s Withholding Tax Law: Employers must withhold income taxes from employee wages
at thi time employeesire paid. You will be liable for the tax payments even if you don't actually
withhold the tax fiom your employees. For more information, call the Department of Revenue at
503-378-4988.
Unemployment lnsurance Tax: Employers are required to pay a tax for unemployment insurance
purposes

the wages of all employees. For more information, call the Oregon Employment
Department at 503-947 -1 488.
Oregon,s Business ldentification Number (BlN): is a combined number for both Oregon
Withholding and Unemployment lnsurance Tax. To file for a BlN, go online to the Oregon Business

Workers Compensation lnsurance: Employers are subject to the Oregon Workers Compensation

Other Responsibilities of Homeowners:
Code Compliance: As the permit holder for a construction project, the homeowner is responsible
for notifying building officials at the appropriate times, so that the required inspections can be
performed. Homeowners are also responsible for resolving any failure to meet code requirements
that may be found through inspections.
property Damage and Liabitity lnsurance: Homeowners acting as their own contractors should
coniact their insurance agent to ensure adequate insurance coverage for accidents and omissions,
such as falling tools, paint overspray, water damage from pipe punctures, flie, or work that must be
redone. Liability lnsurance must be sufficient to cover injuries to persons on the job site.who are not
otherwise covered as employees by Workers Compensation lnsurance.
Expertise: Homeowners should make sure they have the skills to act as their own general
contractor, and the expertise required to coordinate the work of both rough-in and finish trades.

Criteria of Approval: In order to grant ADU approval, the Director shall determine compliance with all applicable
standards specified below:
Section 5.5-125 ADU Development Standards
A) The accessory dwelling unit shall meet all applicable standards in this Code including, but not limited
to; setbacks, height, lot/parcel coverage, solar access and building codes in effect at the time of
construction.

ELECTRIC & WATER UTILITIES
Finding: Section 4.3-130.A of the Springfield Development Code requires each development area to be
provided with a water system having sufficiently sized mains and lesser lines to furnish adequate supply to
the development and sufficient access for maintenance. Springfield Utility Board coordinates the design of
the water system within Springfield city limits.
Condition: Prior to Building Permit approval, the applicant shall coordinate with Springfield Utility
Board prior to trenching for the underground electric and water utilities and for final meter location
approval. This information sholl be shown on the Building Permit.
SANITARYSEWER
Finding: Section 4.3-105.A of the SDC requires that sanitary sewers shall be installed to serve each new
development and to connect developments to existing mains. Additionally, installation of sanitary sewers
shall provide sufficient access for maintenance activities.
Finding: Section 4.3-105.C of the SDC requires that proposed sewer systems shall include design
consideration of additional development within the area as projected by the Metro Plan.
Finding: The existing house and garage is served by a public sewer line running along the northern property
boundary in the backyard.
STORMWATER MANAGEMENT
Finding: Section 4.3-110.8 ofthe SDC requires that the Approval Authority shall grant development approval
only where adequate public and/or private stormwater management systems provisions have been made as
determined by the Public Works Director, consistent with the Engineering Design Standards and Procedures
Manual (EDSPM).
Finding: Section 4.3-110.D ofthe SDC requires that run-offfrom a development shall be directed to an
approved stormwater management system with sufficient capacity to accept the discharge.
Finding: The proposed ADU will be in a long existing accessory building with no additional impervious area
added to the site.

PUBLIC STREETS. SIDEWALKS & IMPROVEMENT AGREEMENTS
Finding: Section 4.2-705.G.2 of the Springfield Development Code requires that whenever a proposed land
division or development will increase traffic on the City street system and that development has any
unimproved street frontage abutting a fully improved street, that street frontage shall be fully improved to
City specifications.
Finding: The laurel hedge along the front ofthe property adjacent to sidewalk has expanded to significantly
impact the width of the sidewalk.
Condition: Prior to occupancy of the Accessory Dwelling Unit, the applicant will trim the hedge to be
flush with the back of sidewalk and not proiect any distance into the 5'width of the concrete.
B) The accessory dwelling unit shall contain a kitchen, bathroom, living and sleeping area that are
completely independent from the primary dwelling.

bathroom, living, and sleeping area.
C) The accessory dwelling unit shall not exceed 80O square feet or the square footage of the primary
dwelling (exclusive of the garage for the primary dwelling), whichever is less.

A hard surface walkway, a minimum of 3 feet wide, shall be required from the primary entrance of the
accessory dwelling unit to the street or walkway serving the primary dwelling.

Section 5.5-130 ADU Design Standards
A) The Accessory Dwelling Unit shall match the primary dwelling. An accessory dwelling unit may be
approved under Type 1 procedure if it meets the following design standards except that these
standards may be altered when necessary to meet current fire or building codes.
l. Exterior finish materials shall be the same as or visually match those of the primary dwelling in
terms of type, size, and placement.
2. Roof pitch shall be the same as the predominate roof pitch of the primary dwelling.
3. The trim around the doors and windows shall be the same type and finish as the primary
dwelling.
4. Windows shall match those of the primary dwelling in terms of proportion (height and width
ratio) and orientation (vertical vs. horizontal).
5. Eaves shall proiect from the accessory dwelling unit addition the same distance as the eaves on
the primary dwelling.

Timelines and Conditions of Approval:
The property owner and/or applicant shall comply with the standards specified herein within 2 years of the Director's
approval as follows:
A. Approval of a building permit within 1 year of the Director's approval, including the following Conditions of
Approval:
1. Prior to occupancy of the Accessory Dwelling Unit, the applicant will trim the hedge to be flush
with the back of sidewalk and not proiect any distance into the 5'width of the concrete.

B. The construction of the accessory dwelling unit shall be complete within 1 year of Building Permit issuance. If
this time line cannot be met, the applicant may submit a written request for a single 1-year extension for
completion.
C. If the timeline established for completion of construction in Subsection B. above is not met and the applicant
has not requested an extension, then the Director shall declare the application null and void.
D. Upon satisfactory completion of Accessory Dwelling Unit, as determined by a Final Site Inspection [prior to
the final building inspection), the City shall authorize the provision of public facilities and services and issue a
Certificate of Occupancy or otherwise authorize use ofthe site.
E. All required improvements shall be installed prior to the issuance of a Certificate of Occupancy or Final
Building Inspection for the development, unless improvements have been deferred for good cause by the
Director as noted below:

Pay applicable Systems Development Charges when building permits are issued for developments within the City
limits or within the Springfield Urban Growth Boundary. (The cost relates to the amount of increase in impervious
surface area, transportation trip rates, and plumbing fixture units. Some exceptions apply to Springfield Urban
Growth areas.J [Springfield Code Chapter II, Article 11]
Systems Development Charges (SDC's) will apply to the construction of buildings and site improvements within the
subject site. The Charges will be based upon the rates in effect at the time of permit submittal for buildings or site
improvements on each portion or phase of the development.
Additional Information: The application, all documents, and evidence relied upon by the applicant, and the
applicable criteria ofapproval are available for free inspection and copies are available for a fee at the Development
Services Department, 225 Fifth Street, Springfield, Oregon.
Appeals: This Type I decision is exempt from the provisions of ORS t97.795, L97 .7 63 and227.773 and therefore
cannot be subject to the appeal provisions of SDC Section 5.3'100, Appeals.

NlLlt0X..n Gemeral. The provisions of this chapter regulate the
exterior envelope, as well as the design, construction and
selection of heating, ventilating and air-conditioning systems,
lighting and piping iasulation required for the purpose of
effective conservation of energy within a building or struc-
ture governed by this code.
A11 conditioned spaces within residential buildings shall
comply with Table N1101.1(1) and two additional measures
from Table N1101.1(2).
JExceptioms:
1. Application to existing buildings shall comply with
Section Nl101.2.
2. Application to additions shall comply with Section
N110i.3.
3. Heated or cooled detached accessory structures that
are not habitable shall meet the following envelope
requirements without any additional measrues:
Walls: R-21/U-0.064; Roofs: R-38/U-0.027 (attic)
or R-20 continuous insulation/U-0.048 (above
d"ck); Windows: U-0.35; Opaque doors: U-0.70;.
Roll-up doors: U-0.50.
N1.101-.2 Application to existing buildings. Alteration a:rd
repairs, historic buildings and change ofuse or occupancy to
buildings, structures or portions thereof sha1l comply with the
requirements in Sections N1101.2.1 through Ni 101.2.3.
NX.101.2.1 Alteration and repair. Alterations and repairs
affecting energy conservation measures shall conform to
the requirements specified in this chapter.
Alterations or repairs which affect components of exist-
ing conditioned spaces regulated in this chapter, those
components shall comply with this chapter.
Exception: The minimum component requirements as
specified ia Table N1101.2 may be used to the maxi-
mum extent practical.
Nn10X.2.2 tr{istoric buildings. The building offi.cial may
modify the specific requirements of this chapter for his-
toric buildings and require in lieu thereof alternative
requirements that will result in a reasonable degree of
energy efficiency. This modification may be allowed for
those buildings specifically designated as historically sig-
nificant by the state historic preservation office(r) or by
official action of a local government.
NX.1.01.2.3 Change of occupancy.or use. Definition of
"Change of use" for purposes of Section N110i.2.3 is a
change of use in an exisfing residential building and shall
include a:ry of the following: any unconditioned spaces such
as an attached garage, basement, porch, or canopy that are to
become conditioned spaces; any unconditioned, inhabitable
space that is to become conditioned space, such as a large
attic.
N1n0n.2.3.1 Charige of'use. A building that changes
use, without any chaages to the components regulated
in this chapter, is required to comply with Table
N1101.2 to the greatest extent practical. Changes of use
that are greater thaa 30 percent of the existing building
heated floor area or more than 400 square feet (37 mz)
in area, whichever is less, shall be required to select otre
measure from Table N1 101.3.
N11t01.2.3.2 Change of occuparecy. Alteration and
repair ofconditioned nonresidential buildings, such as a
small church or school, that are changing occupancy to
residential shall use Table N1101.2 to the greatest
extent practical aad select one measure from Table
N1101.1(2), or one measure from Table N1101.3.
