City, and the Applicant.,, hereinafter called HHEREAS, the applicant has applied ro the City Qommunity Services BuildingDivision for issuance of cert improvements to be located at 0regon or vithin the City,s U arn r an t.i sfI lopmen t Springfield, CountyAssessor's Hap and Tax Lot number VHEREAS, _the applicant has asked the City to authorize the Applicant toiunediately commence development improvements vithout a conpleted plan reviev orsubsequent approval as required by the Springfield Building- Safety- CodeAdministrative Code section 303(a) IIEEREAST-the Applicant has submitted to the City a completed permit appllcation,3 (three) sets of'coirstruction dravings, specificaqioni, and ither daia requiredfor the City to complete the necessary plan reviev of the proposed development improvement. VHEREAS, the intendbd development improvement is of a nature that requires noother reviev approval from other State or local agencies and is exempt from thecriteria established by the Building Safety Division, attached as Exhibit A ofthis Agreement. I{HEREAS, the City has not revieved or approved the submitted materials for the development improvementr the City is therefore unable to confirm at this tirnevhether the permit applicatic:: submitted vitl- be approved, and whether the 5equired construction permits can be issued. UHEREAS, the Epplicant has requested thL city to provide expedited authorizationto Proceed vith certain phases of construction prior to the completion of theCity's reviev of the permit application. VH.EREAS,.the City's fee for the administrative services rendered in providing expedited authorization is S150.00. NO\J, THEREFORE, in consideration of the foregoing recitals and of the mutualpromises contained herein, the City authorizes immediate commencement of the development improvement specified in the permit application subject to thefolloving terms and conditions: AUTHORTZATTON TO PROCEED AGREEMEM Authorization to Proceed Agreement Page 2. or 1. City agrees that the Applicant may immediately commence vith the development improvements set forth in the permit application. City's authorization to proceed is conditioneS hovever, upon Applicant's agreementthat the project vill be constructed as set forth in the attached subrnitted dravings and specifications, except as nay be modified by City, and vill comply vith aII applicable lavs and cotrEencenent of construction is at ordinances. City agrees to reviev Applicant's. permit application in the normal reviev process and to thereafter: a) issue Applicant the appropriate construction permits; or b) advise Applicant of deficiencies in the proposed construction vhich must be remedied before pernits can be issued; or c) advise Applicant of any statutes, ordinances or code provisions vith vhich Applicant must comply vith before City can issue the permit. 3. Applicant agrees that if City finds Applicant's permit application and submitted naterials inadequate or deficient i.n any Banner including.but notlinlted to, the application or the proposed construction do not comply vithall applicable statutes, ordinances or code provislons, Applicant rrill expeditlously cure the deflclencles so that the City Eay issue the requlredpernits. Should Appllcant fat} to expeditlously correct subnltted naterlals,or should correction prove impossible, City nay in it's discretion, take any or aII of the .folloving actions: a) stop all further construction of the project in the manner prescribedin the Springfield Building Safety Code Administrative Code (BSCAC), sEcrroN 201 (d) b) order disconnection of serving utilities in a manner as prescribed in BSCAC, SECTToN 201 (f) c) issue a NOTICE .lj.] O3DER for removal of all such t'or!: in a Fanner as prescribed in BSCAC, SECTION 204. ABATEHEI{T OF UNSAFE, SUBSTANDARD 0R DAIIGEROUS BUILDINGS, STRUCTTRES 0R BUILDING SERVICE EQUIPHEM. Upon receipt of such notice, Applicant shall immediately remove. the vork specified in the Notice and 0rder 4. Applicant agrees, if the issuance of the permit is denied: a) to remove, at the Applicant's sole cost and expense, all completed construction or improvenrentsl and b) to restore the site or structure to it's pre-agreement condition and free of all hazards t oE cons ruc construc Authorization to Proceed Agreement Page 3. 5. Applicant alsoagrees that these inspections do not replace the required plan reviev nor dothey imply any approval of the submitted materials. B. Applicant lgrees that no vork shall be done on any part of the buildingor structure beyond the point indicated in each successive inspectionvithout first obtaining the approval of the Building 0fficial.-Such approvalshall be given only after an inspection has been made of each successivestep in the construction as indicated on the attached Exhibit B. 9-. Notvithstanding any other provisions of this Agreement, this Agreementshall terninate upon lssuance of a bullding pernlt or thirty (3O)-days fromthe.date of this Agreenent, vhlchever first occurs. Appllcant understandsthat all vork on the project shall innediately cease vithout any notlce fromthe City if this Agreetrent terninates before a building-pernit is issued.This agreenent shall terninate on ,(/1/, Lf -il /fEl 10. Applicant agrees to defend, indemnify and hold City harmless from iny and aII costs (including attorney fees), liability or damages of any kind or nature vhatsoever, for personal injury and.. property danage arising from theApplicant's early commencenent of construction and the vork undertaken or completed. 11. The tertrs of this Agreenent shall extend to and be binding upon theparties he.reto and tiieir heirs, successors and assigns. L2. If any suit, action or other proceeding, or an appeal therefrom, isinstituted to obtain, establish, enforce, or compel any right or-obligationresulting from this Agreement, the prevailing party shall be entitled to recover from the adverse party, in addition to costs and disbursementsr' suchadditional sums as the courts, both trial and appellate, may judge reasonable attorney fees.
