Site plan Developrnent Agreement 3. C0NDITIONS. The Applicant agrees to fulfill al'l specific conoitjons ofapproval requi re<l by the Ci ty j i steo i n REC ITALS pri or to occupancy, unl esscertain conoitions have been oeferred to a later date in accordance with section 31.110 of the Springfielo Development Cooe. 4. MODIFICATI0NS. The applicant agrees not to modify the approved FinalSite Plan without first notifying the City. Mooificat'ions to the Final Site P'lan shal l be revi eweo i n accordance wi th Secti on 31 . 100 of the Spri ngfi el o Deve'lopment Cooe. 5. MAINTAINING THE usE. The app'licant agrees ro the following: (a) The builoing ano site shall be maintaineo in accoroance with theprovisions of the Springfielo Development Cooe in order to continue the use. (b) It shall be the continuing obligation of the property owner tomaintain the planting required by Section 31.140 of the Springfieio OLvetopmentCooe in an attractive manner free of h/eeds ano other invaoing vegetation. Inaddition, plantings in the vision clearance area shall be trimmeo io meet the 2l/2 _foot height standard in accordance with Section 32.070 of the Springfielo Devel opment Cooe. (c) Parkfng lots shal'l be maintained by the property oh,ner or tenantfn a conoition free of litter or dust, and deteriorated pavemenlconditions shallbe improved to maintain conformance with these standards. (o) Unoevelopeo 'lano within the oevelopment area shal'l be maintainedfree of trash and storeo materials in a mowed ano attractive manner. Unoeve'lopeolano shall not be used for parking. 6. In addition to all ot.her remedies which may be provioeo by law orequity (inc1uoing but not limiteo to penalties provioeo 6y ap'pticable siate lawor ci ty ordi nances ) App'l i cant agrees that Ci ty may eniorce Appl i cant' sresponsibilities by withholoing Applfcant's Fihal bccupancy Permit, andterminating any Temporary Occupancy Permit which may have been granted.
