ITEM TITLE: AUTHORIZATION FOR PILOT PROJECT TO APPROVE FIREWORKS AND
CHRISTMAS TREE SALES LOTS IN MIXED USE COMMERCIAL ZONE.
ACTION REQUESTED: Adopt/Not Adopt a Resolution: A RESOLUTION TEMPORARILY PERMITTING SEASONAL FIREWORKS AND CHRISTMAS TREE SALES
LOTS IN MIXED USE COMMERCIAL ZONES.
ISSUE STATEMENT:
Request authorization for a pilot project for the period of one year to expand the
Temporary Lot Sales to include Mixed Use Commercial Zoning.

DISCUSSION/
FINANCIAL IMPACT:
Historically Fireworks and Christmas Tree sales lots are only permitted in
Community Commercial and Major Retail Commercial narrowing the locations for business opportunities within Springfield.
Staff received a request for a Fireworks Stand on property located at 705 S. A Street which is zoned Mixed Use Commercial. Temporary lot sales are not currently permitted within in the Mixed Use Commercial Zone.
For the year 2018 there were seven (7) fireworks stand licenses issued and
four (4) Christmas tree lot licenses issued.
As part of a continued strategy to support business efforts within Springfield, staff
requests authorization for a pilot project for the period of one year to expand locations where Temporary sales lots are allowed in Springfield to include the
Mixed Use Commercial Zone.

A RESOLUTION TEMPORARILY PERMITTING SEASONAL FIREWORKS AND CHRISTMAS
TREE SALES LOTS IN MIXED USE COMMERCIAL ZONES WHEREAS, the City of Springfield has adopted business license regulations for seasonal fireworks and
Christmas tree sales in Sections 7.150 through 7.156 of the Springfield Municipal Code;
WHEREAS, Section 7.154 of the Springfield Municipal Code establishes standards of operation
applicable to these temporary sales facilities, including specifying the commercial zones in which these
temporary sales lots are permitted;
WHEREAS, the City has received a request to expand the zones in which these temporary sales lots
are permitted to include the Mixed Use Commercial zone; and
WHEREAS, the City Council finds that it is in the public interest to permit seasonal fireworks and
Christmas tree sales on properties in the Mixed Use Commercial zone for a trial period of one year to
allow the Council to determine whether to amend the municipal code to permit fireworks and Christmas
tree sales lots in the Mixed Use Commercial zone on a permanent basis,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD:
Section 1: For the one-year period beginning June 23, 2019 through June 22, 2020, fireworks sales lots and Christmas tree sales lots may be allowed on property that is zone MUC – Mixed
Use Commercial, provided that said lots meet all other applicable requirements in Section 7.150
through Section 7.156 and comply with all other City, state, and federal laws.
Section 2: This Resolution will take effect upon adoption by the Council and approval by the
Mayor.
