REEMENT, hereinafrer "Agreemenr", is entered into tfris 37 day

SPBIN FIELD, hereinafter "City", and Dr. Thomas Huhn and Dr. Robert Strassburg, hereinafter
"Applicant", in accordance with Sections 31.090, 3.070(3), 3.080(3), 3,090(3), and 3.100(3) of the
Springfield Development Code,
RECITALS
WHEREAS, on the 2Oth day of November, 1991, the City approved the Final Site Plan (Journal
I'lumber 91-09-162) submitted by the Applicant for the purpose of allowing the expansion of an
existing dental office located at 528 Mill Street (Tax Lot 4700 on Tax Assessor's Map 17-03-35-23),
WHEREAS, in consideration for Site Plan approval, the issuance of a Building Permit, and the
issuance of an Occupancy Permit, as specified in the Springfield Development Code, Section 31,090,
Applicant agrees to comply with all the standards of the Springfield Development Code and Springfield
IMunicipal Code which may be applicable to this development project unless modified or excepted by
the Site Plan Review Development Agreement, Planning Director, Planning Commission, Building
Qfficial or their agents, or the Fire Marshal, which modifications or exceptions shall be reduced to
r..,riting.
WHEREAS, in consideration for the Site Plan Approval, the issuance of a Building Permit, and
rhe issuance of an Occupancy Permit, as specified in the Springfield Development Code, Section
31.090, Applicant agrees to comply with the following specific conditions imposed by the City as part
of the Site Plan approval:
1 . All improvements shall be constructed/installed as shown on the Final Site Plans dated
1 991.
The proposed addition shall not encroach on the existing sanitary sewer easement, shown on
the Final Site Plan, on the west portion of the property.
Adequate access, in the form of an approved sewer cleanout, to the sewer line at the west
portion of the property, as shown on the Final Site Plan, shall be provided.
A backflow prevention device approved by the Oregon State Health Division must be installed
on the water service line, as shown on the Final Site Plan'
Two approved street trees shall be provided in the curbside planting strip along Mill Street, as
shown on the Final Site Plan.
A five-foot landscaped setbacti, planted with two trees and a vegetative screen shall be
provided along the north edge of the parking area, as shown on the Final Site Plan'
A sight-obscuring screen shall be provided for the trash receptacle at the rear of the property,
as shown on the Final Site Plan.
The parking space at the front of the building shall be designated as reserved for the disabled
by a sign which shall show the international symbol of accessibility, and which shall not be
obscured by a vehicle parked in the space, as shown on the Final Site Plan'

AGREEMENT
FINAL SITE PLAN. The Applicant has submitted a Final Site Plan in accordance with SeCtiOn31.080 of the Springtield Development Code.
STANDARDS. The Applicant agrees to f ulfill all applicable srandards specif ied in the Springf ield
Development Code and the specific standards listed in "RECITALS" priorro occupancy, unless
certain conditions have been deferred to a later date in accordance with Section 3.l.040(4)(b)
of the Springfield Development Code.
CONDITIONS. The Applicant agrees to fulfill allspecific conditions of approvalrequired by the
City listed in "RECITALS" priorto occupancy, unless certain conditions have been deferred ro
a later date in accordance with Section 31.040(4)(b) of the Springfield Development Code.
MODIFICATIONS. The Applicant agrees not to modify the approved Final Site Plan without
first notifying the City. Modifications to the Final Site Plan shall be reviewed in accordance
with Section 31.100 of the Springfield Development Code.
5. MAINTAINING THE USE, The Applicant agrees to rhe following:
(a)The building and site shall be maintained in accordance with the provisions of the
Springfield Development Code in order to continue the use.
(b) lt shall be the continuing obligation of the property owner to maintain rhe planting
required by Section 31.040 of the Springfield Development Code in an attractive
manner free of weeds and other invading vegetation. ln addition, plantings in the
vision clearance area shall be trimmed to meet the 2 1/2 foot height standard in
accordance with Section 32.070 of the Springfield Development Code.
(c) parking lots shall be maintained by the property owner or tenant in a condition free of
litter or dust, and deteriorated pavement conditions shall be improved to maintain
conformance with these standards.
(d) Undeveloped land within the development area shall be maintained free of trash and
stored materials in a mowed and attractive manner. Undeveloped land shall not be
used for Parking.
ln addition to all other remedies which may be provided by law or equity (including but not
limited to penalties provided by applicable State Law or City Ordinances), Applicant agrees that
the City may enforce the Applicant's responsibilities by withholding Applicant's Final
Occupancy Permit, and terminating any Temporary Occupancy Permit which may have been
granted.
Any Final Site plan approved becomes null and void if construction does not commence within
two years of the date of this Agreement.
