Homeowners acting as their own general contracto6 to construct a new home
or make a substantial improvement to an existing structure, can prevent many problems
by being aware of the following resPonsibilities:
Homeowners who use labor provided by workers not licensed by the Construction Contractors
Board, may be considered an employer, and the workers who provide the labor may be considered
employees. As an employer, you must comply with the following:
oregon,s withholding Tax Law: Employers must withhold income taxes from employee wages
at thi time employees are paid. You will be liable for the tax payments even if you don't actually
withhold the tax from your employees. For more information, call the Department of Revenue at
503-378-4988.
Unemployment lnsurance Tax: Employers are required to pay a tax for unemployment insurance
purposes on the wages of all employees. For more information, call the oregon Employment
Department at 503-947-'l 488.

Code Compliance: As the permit holderfor a construction project, the homeowner is responsible
for notifying building officials at the appropriate times, so that the required inspections can be
performed. Homeowners are also responsible for resolving any failure to meet code requirements
that may be found through inspections.

contact their insurance agent to ensure adequate insurance coverage for accidents and omissions,
such as falling tools, paint overspray, water damage from pipe punctures, flre, or work that must be
redone. Liability lnsurance must be sufficient to cover injuries to persons on the job site who are not
otherwise covered as employees by Workers Compensation lnsurance
Expertise: Homeowners should make sure they have the skills to act as their own general
contractor, and the expertise requrred to coordinate the work of both rough-in and finish trades.

1) Retaining wall is less than 4'tall and per R404.1.1ofthe 2017 ORSC if the wall is 48" or less and not
subject to hydrostatic pressure it is not something that shall be required to be engineered. However,
the drawing that I have looks as if the footing that supports the columns that support the roof beam
for the carport could be compromised in the excavation process to put in the wall. lt looks like, maybe
a 1:1 slope, from the heel of the retaining wall footing to the bottom of the footing supporting the
columns for the carport. That is my concern; that it does not comply with R403.1.9.2. Please read over
R403.1.9.4 for additional requirements for the need of a licensed engineer.
2) Where did you get the dimension of 9'-4" between beams? I have attached the drawing that was
submitted to me so you can see what I see. I have a plan that shows 16'feet from wall of existing
home, minus 5'side yard setback and the rest ofthat dimension is carport. 16'- 5'to the face ofthe
column is LL' minus the 3.5" thickness of the column, x2 for both sides of the carport, subtracts
another 7" making the span at least 10'-5". I must be looking at a different plan that you are looking at.
please send me the information you have so we can compare notes. I ran my information through
StruCalc and I got a return of "lnadequate by 13.3o/J' , hence the reason I told the applicant that the
rafters would need to be increased to 2x8s .Given the fact that we did get snow last winter that
exceeded 25lbs per square foot and collapsed multiple roofs in our area, I scrutinize this closely. I
included that attachment as well.
3) I ran the 4x12 through StruCalc as well and it was significantly deficient. I have attached that
documentation also.
My apologies that you feel that I am holding this project to unique standards that have never been seen in any
jurisdiction during your 43 years of design experience but I am not trying to be difficult, just trying to do my
job with the tools that I have at my disposal and looking out for the applicant to make sure that his structure
will not collapse. I take no offense if you would like to speak to our acting building official, Robert Castile and
have a conversation with him about this.

Thanks for getting back to me.
I had a couple questions about the need for engrg. this simple project:
1) I've never been asked to have a small retaining watl less than 4' tall wet-stamp engineered anywhere in OR
or WA in 43 years of design. No jurisdiction I know requires that.
Am I missing something? lt is actually over-designed.
ln this case, the ret. wall (bottom of ft9. to top of soil retained) is only 34".
The slab edge & curb are not to be calculated in this, but even if it was, it's still under 48". I pinned it to the
slab only to maintain a tight fit, which also increases its retaining strength.
lf you deem it necessary for some other reasons, of course, we can send this for engrg. - but it will.iust delay
this smalljob, add cost to it & my struct. engr. won't chanBe anything, since she has already looked at this (&
the items below) & was satisfied as drawn. This ret. wall was based on all her past engrd. designs, but of
cou rse, they were 7'tall.
2) My span tables for Doug Fir 2x6 rafters allow a clear span 10'-7" @ 24" o.c., (L2,-tt" @ 16,, o.c.) Forthis
job, the clear span is only 9'-4" between beams. I don't see the problem.
We can certainly go with the 16" center layout, but my engr. said it was fine for the 20-25# snow load
expected in th is area.
Plus, it is a steep pitch with metal roofing, so it will not be any kind of a load issue.
3) lfelt the 4x12s were semi-marginal, even though they also have an added nailed 2x4 top plate - but I added
my standard ensineer-desien ed knee braces that we always use for carports. lt would eliminate the need for
any additional posts & pads, by cutting the spans by 48" each. ln addition to the Simpson post caps. My engr.
agreed.

They also help with lateral bracing, but my engr. said the upper sheathing was enough for the shear forces &
the knee braces were actually overkill reSardinS that.
I have used this engrd. detail / design dozens of times on stamped Plan Sets in Lane, Eugene, etc. - & a couple
times in Spfld. So not sure what might be the concern here.
Mr. Luek is not adverse to adding the two extra posts you wanted, but why - if not needed?

Need the following items:
. 4x12 #2 DF is inadequate for current spans. My solution that I offered up to him was to add additional footings and
support columns to shorten the spans or supply me with a stamped set of engineering calculations proving that the current
design works.
o Need stamped engineered calculations for the retaining wall that is holding back the surcharge from the parking area.
. 2x6 rafters do not work according to Strucalc. lf he has an engineer working on the previous 2 items, he m?y want to have
the engineer run the math on the 2x6 rafters as well, otherwise lwill redline the plans and require that 2x8s are used for
the 11'span with a 5/12 pitch.
