ACTION REQUESTED: Adopt/not adopt the following resolution: A RESOLUTION INITIATING VACATION OF PUBLIC RIGHT-OF-WAY EXTENDING EASTWARD FOR A LENGTH OF 306-FEET FROM 5TH STREET BETWEEN ‘Q’ STREET AND ‘T’ STREET. ISSUE STATEMENT: The City Council is requested to consider a resolution to initiate vacation of a piece of undeveloped City-owned Right-Of-Way (ROW) that is located east of 5th Street and approximately 225 feet south of T Street. The proposed ROW vacation is requested to facilitate multi-family residential development on the surrounding parcels. ATTACHMENT: Attachment 1: Resolution with Exhibits DISCUSSION/ FINANCIAL IMPACT: The subject right-of-way (ROW) is located approximately 225 feet south of T Street within City limits, just north of parcels zoned High Density Residential (HDR) and just south of parcels zoned Medium Density Residential (MDR). The approximately 306-foot long section of undeveloped public right-of-way was dedicated to the City for public use in 1978. The Homes for Good organization is now developing all parcels surrounding this right-of-way segment, and if approved, the vacated property will accrue to the current owners and be incorporated into the multi-family residential development conditionally approved as Tentative Site Plan Approval (811-19-000158-TYP2). The existing sanitary sewer line within the undeveloped right of way will have no further public benefit, is not needed to serve adjacent parcels or the redevelopment project, and is proposed to be vacated with the public right-of-way, relieving the City of any future maintenance responsibilities. There are no other public utilities located within the right of way segment, and extension and location of public facilities serving the site have been provided during Tentative Site Plan Review procedures. If this vacation is initiated by the City Council, a public hearing will be scheduled for Monday, October 7, 2019. City staff will provide the Council with an informational packet prior to the meeting. Once the public hearing is closed, the Council will be able to deliberate and decide whether to adopt/not adopt the ordinance to vacate. There are no direct financial impacts associated with the initiation of this vacation process by City Council resolution. PAGE [_ of _] CITY OF SPRINGFIELD, OREGON RESOLUTION NO. ___________ A RESOLUTION INITIATING VACATION OF APPROXIMATELY 306-FEET OF PUBLIC RIGHT- OF-WAY EXTENDING EASTWARD FROM 5TH STREET BETWEEN ‘Q’ STREET AND ‘T’ STREET WHEREAS, pursuant to Oregon Revised Statutes (ORS) 271.080, the City governing body may initiate vacation proceedings and make such vacation without a petition or consent of property owners; notice shall be given as provided by ORS 271.110, but such vacation shall not be made before the date set for hearing, nor if the owners of a majority of the area affected object; and WHEREAS, Lane County’s low-income housing agency, Homes For Good, has requested that the City initiate vacation of the undeveloped right-of-way shown in Exhibit A to facilitate development of multi- family affordable housing on the immediately adjacent properties; and WHEREAS, City staff has recommended initiation of this right-of-way vacation after determining there are no plans to develop or extend it for public street use and after determining that the existing sanitary sewer located in the right-of-way may be converted to a private sewer to serve only the adjacent properties. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD: Section 1: The City Council hereby initiates the vacation of public right-of-way as more particularly described and set forth in Exhibit A attached hereto. Section 2: This Resolution will take effect upon adoption by the Council and approval by the Mayor.
