Attached are two documents which should enable you to proceed with the tree felling application. The first is the stipulated judgement settling the property condemnation. With that, SUB is acquiring all of the property associated with the transmission line, not just the easements. This is all of tax lots 1000 and 1100 and the lower leg of tax lot 3701. (As noted in the Judgement, SUB will be submitting a property line adjustment within the next few weeks to shrink 3701 to contain the property Miranda still owns and grow 1100 to absorb the lower leg of 3701 which SUB has acquired.) The second document is the PUC dismissal order. You might not need this for tree felling, but here it is just in case. Both of these documents are in the public record as part of their own process, so it's okay to include these in our application public record. Both of these will apply to the site plan review and hillside overlay applications also, but this submittal here is mainly for tree felling so we can get that moving. Thanks Andy. My concern was —and still is until I'm convinced otherwise — that the project impacts depicted on the site plans (including tree felling) extended beyond the SUB transmission line easement delineation and presumed area of condemnation. Because this indicated impacts to property not under SUB ownership and control, staff decided that the third party concurrence would be required and, in this case, highly advisable in the event of an appeal. If that has been rectified through the condemnation action then we should be ready to proceed.
