HomeMy WebLinkAboutOrdinance 876 09/25/1946 eCeK 332 ORDINANCE NO. 876 AN ORDINANCE VACATING THE FOLI.OVING DESCRIBED AREA, TO-WIT: That portion of "J" Street in Springfield, more particularly des- cribed as follows: Beginning at the Southeast corner of intersection of 12th and "J" Streets in Springfield, Lane County, Orpon thence North 890 54' East 1461.3 Peet, thence North 29 09Z East 68.7 feet thence South 890 541 West along the North line of "J" Street 1494.7 feet thence south 00 10' East 60 feet to the place of be- ginning all being in Lane County, Oregon, and declaring an emergency. WHEREAS, by resolution duly adopted on August 12, 1946, the Common Council of the City of Springfield on its own motion declared its intention to vacate e portion of "J" Street, more particularly described below, and WHEREAS, two notices, as required by law, were duly posted, upon the property to be vacated, on August 13, 1946, declaring the intention of Com- mon Council to vacate the aforesaid portion of "J^ Street, end WHEREAS, for four consecutive weeks notice of the proposed street vacation was duly published in the Springfield News, proof of publication of which is on file with the City Recorder, and ,EEREAS, a hearing was held pursuant to said resolutioninthe Council Chamber in the City Hell of the City of Springfield on Monday, September 16th, at 7:30 P.M., and at said time the Council heard all objections; and WHEREAS, all persons owning property abutting on the portion of the street proposed to be vacated have consented to said vacation; and WHEREAS, it appears to the Common Council to be to the best interests of the City and in the best interests of the property owners affected to vacate the aforesaid street, NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1. Common Council of the City of Springfield finds that due and legal notice of the aforesaid hearing was published and posted as required by law, and that no valid objection to said vacation was made at the hearing aforesaid or filed, and finds that the consent of the owners of the abutting property wee obtained; and that the public interest will not be prejudiced by the vacation of the proposed area. �.c 332 Fr.-E217 Section 2. The Common Council finds that there are no liens unpaid in favor of Lane County or the City of Springfield against the said property. Section 3. That the following described area, to-wit: Beginning at the Southeast corner of intersection of 12th and "J" Streets in Springfield, Lane County Oregon, thence North 890 54' East 1461.3 feet, thence North 290 69' Fast'68.7 feet thence South 890 541 'Nest along the North line of "J" Street 1494.7 feet thence South 00 101 East 60 feet to the place of beginning all being in Lane County, Oregon. be and the same is hereby vacated, and the area so vacated, being a street, shall revert forthwith to the abutting property owners pursuant to Section 96-1337 O.C.L.A. Section 4. The recorder be and he is hereby directed to file a certified copy or this ordinance with the County Clerk of Lane County. Section 5. The Common Council hereby declares it to be expedient and necessary for the immediate preservation of the public health safety and morals and in the public interest that this ordinance shall take effect immediately upon its passage, and that an emergency is hereby declared.
