AGENCY OF THE CITY OF SPRINGFIELD
RESOLUTION NO. 2011-03
A resolution of the Springfield Economic Development Agency authorizing the
following:
1. The acquisition of 4095 and 4251 Franklin Boulevard; and
2. Ratifying providing funds to the City of Springfield to acquire three parcels of
property along the south side of Franklin Boulevard identified as 17-03-33 tax lots 100
& 200, and 17-03-34-33 tax lot 500, formerly known as the Department of
Administrative Services property; and
3. Extending the Intergovernmental Agreement to advance and repay funds
needed for urban renewal projects for three years for 2011-2012 through 2013-2014.
4095 and 4251 Franklin Boulevard
WHEREAS, the Glenwood Urban Renewal Plan of November 15, 2004, provides that a
key component of the Plan is to assist in the improvement of streets, curbs,
sidewalks, encourage new development, as well as to assist improvements to the
water, stormwater, and sanitary services infrastructure; and
WHEREAS, the Plan indicates activities to improve the visual appearance, provide
safer pedestrian environments, improve landscapes, construct public parking,
activities and assembling of right-of-way for all are permissible; and
WHEREAS, the Plan also provides for authority to acquire and dispose of land to assist
in the private development of the Urban Renewal Area; and
WHEREAS, 4095 and 4251 Franklin Boulevard have been made available on the
market and SEDA is interested in acquiring the properties for any of the purposes
described above or otherwise authorized in the Plan through a voluntary arms-length
transaction; and
WHEREAS, SEDA has available sufficient funds to acquire the parcels based upon its
ability to borrow these funds from the City of Springfield pursuant to a pre-existing
agreements between the City and SEDA providing a line of credit for these purposes.
This Agreement was initially authorized November 29, 2005, then extended through
the year 2008-2009 on July 18, 2008, and again on July 21, 2008, and extended
again on November 21 , 2011; and
WHEREAS, each parcel has its own set of unique issues regarding easements,
covenants, and possible environmental contamination, as well as price; and
WHEREAS, the purpose of this Resolution is to authorize staff of SEDA to perform
appropriate due diligence and, upon successful resolution of the easements,
covenants, environmental issues and contamination and agreement on price, to
acquire said parcels.
17-03-33 Tax Lots 100, 200, and 17-03-34-33 Tax Lot 500
WHEREAS, on July 22, 2009, the City of Springfield acquired these three parcels for
all the purposes identified above and more specifically for road right-of-way, utility,
riparian, stormwater, wetland protection, access; and
WHEREAS, SEDA provided the funding ($700,000.00), and these parcels were
acquired by the City; and
WHEREAS, a portion of the properties are currently leased to the construction
contractor at the I-5 bridge near the Willamette River; and
WHEREAS, after the Willamette River bridge is completed and the City determines its
needs of the property for right-of-way, water, stormwater, wetlands, and utilities, the
plan is to sell the remainder for private development consistent with the Glenwood
Urban Renewal Plan and adopted land use plan.
WHEREAS, the three year Intergovernmental Agreement to advance and repay $1.5
million to the Springfield Economic Development Agency for costs of urban renewal
projects needs to be extended for an additional three years.
NOW, THEREFORE, be it resolved as follows:
That upon successful preliminary negotiation for the voluntary arms-length acquisition
of 4095 and 4251 Franklin Boulevard and after successful resolution of the covenants,
easements, environmental and transportation and price issues, the matter be
returned to the SEDA Board for final action; and
BE IT FURTHER RESOLVED, that SEDA hereby ratifies providing funds ($700,000.00)
for the acquisition of 17-03-33 Tax Lots 100 & 200 and 17-03-34-33 Tax Lot 500 and
to the City of Springfield for road right-of-way, access, utility, riparian, stormwater
and wetland protection purposes with the remainder to be offered for later sale.
BE IT FURTHER RESOLVED, that the Intergovernmental Agreement to advance funds
needed for urban renewal projects, initially approved November 29, 2005, extended
SEDA RESOLUTION 2011-03
on July 21, 2008 and is hereby extended an additional three years through fiscal year
2013-2014.
Adopted by the Springfield Economic Development Agency, a Urban Renewal Agency
of the City of Springfield, by a vote of 7 for and 0 against, this 21st day
of November , 2011. 2 absent - Stewart and Leiken.
