ISSUE
STATEMENT:
In September 2012, the Law office of Bill Kloos, PC submitted a Notice of Intent to Appeal the City and County Ordinances adopting the Glenwood Refinement Plan
update to LUBA on behalf of Shamrock Homes, LLC, and the Springfield City
Council directed the City Attorney’s Office to litigate the appeal.

DISCUSSION: Following the Petitioner’s September 2012 Notice of Intent to Appeal submission
to LUBA, the City (Respondent) submitted a copy of the Record to LUBA in November 2012. In January 2013, the Law office of Bill Kloos submitted the
formal Petition on behalf of Shamrock Homes, LLC. The petition contained nine
assignments of error, asserting violations of Statewide Planning Goals 2, 5, 8, 9, 10, 11, 12, and 15, as well as the use of unacknowledged land use regulations and
imposition of fees contrary to state statute.
Upon consultation with City Staff, the City Attorney’s Office has been preparing
the Respondent’s Brief. The Response Brief is due to LUBA on May 3, 2013, and Oral Arguments are scheduled for May 16, 2013.
