5. PUBLIC HEARINGS – a. Zone Change request by Shaw / Hammer, ODOT Jo. No. ZON2002-10350 – The subject properties (2) comprise approximately on half acre located at the intersection of 18th Street
and Mohawk Boulevard. The current zoning is not consistent with the Metro Plan designation. The proposed zone change would eliminate the “plan/zone conflict” and bring the zoning of the site into conformance with the Metro Plan Diagram.
Plan/zone consistency is addressed during refinement planning, legislative rezones or by property owners
at the time of development. In this case, the developers (Shaw/Hammer) have received site plan approval
for a commercial use on the site and are required to eliminate the plan/zone conflict on the development area as a condition of that approval. The developer is in the process of purchasing adjacent property for
inclusion in the development area, therefore te adjacent property owner (ODOT) is a co-applicant. (Donovan)
b. Public Hearing Continuation on Request for Metro Plan and Gateway Refinement Plan
Amendments Jo. No. 2002-08-0243 and Jo. No. 2002-08-0244 (Peacehealth) - On December 3, 2002, the Planning Commission opened a public hearing to accept testimony regarding PeaceHealth’s request to amend the Metro Plan Diagram and the Gateway Refinement Plan (GRP) Diagram and text to allow for PeaceHealth’s development at the Gateway MDR site. Fifty-four people
sign up to speak (Fifty-nine pre-numbered cards were distributed, five were not used). Testimony was accepted from individuals who registered to speak on cards one through forty before the Planning Commission continued the heating to December 17, 2002. The fifteen people remaining to testify will do
so at the beginning of the December 17, 2002 hearing continuation. At the conclusion of the oral testimony the Commissioners will have an opportunity to question staff, the applicant and individuals who provided testimony. (Stephens)
