A. AMENDMENT OF THE SPRINGFIELD DEVELOPMENT CODE – Jo. # 2002-02-0038
CITY OF SPRINGFIELD, APPLICANT – The Planning Commission will re-open the public hearing continued from April 2, 2002 concerning the amendment of the Springfield Development Code (SDC), consider both written and oral testimony, conclude the public hearing on this matter and forward a recommendation to the City Council to approve, approve with conditions or deny the request. 6. QUASI-JUDICIAL PUBLIC HEARING –
A. APPEAL OF THE DIRECTOR’S DECISION: Site Plan Review – Jo. No. 2002-05-0136 – Paul
Skillern/Kendall Development Corp – The appellant, Paul Skillern/Kendall Development Group is appealing three conditions of the Director’s decision to approve a Site Plan Review Application (Jo. No. 2002-02-0034). The Planning Commission must conduct a public hearing on June 18, 2002 and render a decision to either uphold the Conditions of Approval placed on Kendall’s Site Plan Review or direct staff to amend the decision. The property is located at 575, 705 and 739 South A Street in Springfield. (Pauly)

B. VACATION OF RIGHT- OF –WAY – Jo. No. 2002-00-0000 - Hammer – A subdivision plan was approved for the applicant’s property on February12, 2002. The applicant indicated at that time that he intended to file for a right-of-way vacation (ROW) for an abandoned segment of County Road 221 that cut across his property. Property redeemed from the vacation shall be added to the adjacent properties from whence the land was first acquired for the ROW. If the
vacation is approved, the affected property lines shall be adjusted to reflect the correct parcel boundaries. The staff report concluded that the proposal is consistent with the criteria for approving right-of-way vacations. Comments received through the Development Code Review Committee process expressed the need to reserve certain easements to protecting public and private utility facilities and access
ways that are part of the newly created subdivision. The City Surveyor compiled a list of such easements and access ways and forwarded these to the applicant. The applicant is drafting legal descriptions for these facilities and will record them at the conclusion of the vacation process.. Recording these easements over the right-of-way to advance of the vacation would nullify their effect. While the list compiled by the surveyor captures the known easements and access ways that will require protection, finalization of the public improvement plans for the subdivision may require some easements to be added or relocated.
