A. Deliberation of Appeal from January 15, 2002 Public Hearing - Temporary Use - Emergency Medical Hardship Jo# 2001-10-0214 – A public hearing was conducted on January 15, 2002 concerning an Appeal of the Director's Decision to deny an Emergency Medical Hardship. After the hearing the Planning Commission requested that the record be held open
to receive information from staff regarding the legislative history of the Emergency Medical Hardship ordinance. Specifically, members of the Commission were interested in the City Council's intentions when they amended the ordinance in 1994 to allow an applicant to renew a hardship approval without submitting another Type II application. The Planning Commission must continue their deliberation of the issue and render a decision to
uphold the Director's denial of the Hardship dwelling or reverse the Director's decision allowing the appellant to live in a trailer placed on Assessor's Map #17-03-27-44 Tax Lot 1000. (Pauly)
B. Variance - Journal # 2001-12-0224 Kramer- The applicant has requested a Variance to the requirements of SDC 16.050(4), which prohibits the location of accessory structures between the front and side yard and a principle building, in order to construct a 120-square
foot storage shed on his property, located at the corner of E and Kelly Boulevard. (Julber)
