No. 2000-01-0003 Continued from Planning Commission meeting, February 15, 2000. Public Hearing was closed, but the Record was held open to February 18, 2000 at 5:00 p.m. Alberto Miranda, the Appellant, is appealing a portion of Condition 7 of the Development Services Director’s decision to approve a Type II Site Plan Review application (Jo. No. 1999-05-0130) for the construction of a 15,314 square foot warehouse for Continuity Data, Inc. CDI Vaults. Condition 7 called for paving portion of East 21st Avenue and Morton Street. The property is located at the east end of East 21st Avenue in Glenwood. A summary of issues raised by the Appellant are: requiring the paving of East 21st Avenue is an unlawful exaction, the Glenwood Refinement Plan (GRP) is not applicable to the decision, GRP policies were not incorporated into the Springfield Development Code (SDC) as site review standards, and the restrictions on the use of East 21st Avenue are not authorized by Law. (Karp) B. Appeal of the Director’s Decision Jo. No. 2000-01-017- On January 12, 2000 the appellant, Sycan B Corporation, received Tentative Subdivision Approval to subdivide a 4.2 acre property into four lots in the Community Commercial (CC) district. The site is located inside of the city limits and the Gateway Refinement Plan area, southeast of the Kruse Way and Hutton Street intersection, south of Beltline Road and east of Gateway Street. On January 21, 2000, the appellant filed an appeal of the Director’s decision. The Appellant request that the Planning Commission alter the following conditions of approval: 4. Incorporate a common drainage system, including water quality features, for all of the lots in this proposal. The drainage system must be designed, approved and constructed or bonded prior to approval of the Final Plat. The meeting location is wheelchair-accessible. Create a pedestrian and bicycle accessway from the southern terminus of the proposed private driveway to the Oriole Street/Pheasant Blvd. Rights-of-way, south of the subdivision area by recording an access easement from the Hutton/Kruse intersection to the Oriole/Pheasant rights-of-way and filing a performance bond with the City for the construction cost.
