No. 2000-01-0003 Alberto Miranda, the Appellant, is appealing a portion of the Condition 7 of the Development Services Director’s decision to approve a Type II Site Plan Review application (Jo. No. 1999-05-0130) for the construction of a 15,314 square foot warehouse for Continuity Data, Inc., CDI Vaults. Condition 7 called for paving a portion of East 21st Avenue and Morton Street. The property is located at the east end of East 21st Avenue in Glenwood. A summary of issues raised by the Appellant are : requiring the paving of East 21st Avenue is an unlawful exaction, the Glenwood Refinement Plan (GRP) is not applicable to the decision, GRP policies were not incorporated into the Springfield Development Code (SDC) as site review standards, and the restrictions on the use of East 21st Avenue are not authorized by law.
