Philip I would suggest the project surveyor and the City Surveyor should discuss the best course of action for
releaSing these easements Not all of the easements listed below were originally proposed for vacation, as an
example. the public road easements to Lane County were proposed to be retained and this stili may be a valid
action However. the County may want to divest Itself of redundant road easements where a public (City) road IS
proposed to be dedicated I'm not sure If public road dedication would automatically "overwrite" underlYing public
road easements once the plat IS recorded
There are two Instruments Identified for vacation on Sheet T1 6 of the 2006 tentative plan. but only one appears
on the current title report #7722531 This Instrument Will probably require a formal vacation action. unless there
IS another mechamsm that would allow the City to release ItS Interest In the land On a related note. It IS assumed
that private (third party) easements proposed for qUitclaim deeds on Sheet T1 6 of the 2006 tentative plan Will be
addressed prior to final plat A recorded disclaimer of Interest was submitted at the pre-submittal meeting and
addresses SIX of the easements listed on Sheet T1 6
A qUitclaim deed IS suggested tor the easement to Oakway Water District (#44944) but thiS wasn't submitted at
the meeting Additionally. the seven public right-of-way easements to SUB ElectriC listed below are not Identified
on the table of eXisting easements (Sheet T1 6) or depleted on the plan sheets (that I can determine). but they
appear In the current title report For thiS reason. their status and pOSSible Influence on the subdiVISion lots are
unknown Depending upon the location and dimenSions of these easements, It may be both necessary and
deSirable to extingUish them As we discussed at the meeting. public easements can be vacated through a staff
report and deCISion and Peace Health Will endeavor to combine all required vacation actions Into a Single
application If It IS conclUSively determined that the relict easements can be vacated/extinguished through
recording the subdiVIsion plat. staff would certainly support thiS action

process? I believe that approach was In our proposal and reflected In tentative plan. which was approved by the
City Your e-mail states that the follOWing "may" require action prior to filing the final plat - who can tell us
definlllvely If they do or do not require prior action. and when can we expect an answer to that question
